99 relating to requiring certain applicants for motor vehicle
1010 registration to provide proof that the applicant holds a valid
1111 driver's license.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter D, Chapter 502, Transportation Code,
1414 is amended by adding Section 502.1536 to read as follows:
1515 Sec. 502.1536. EVIDENCE OF DRIVER'S LICENSE. (a) Except as
1616 provided by Subsection (d), a county assessor-collector may not
1717 register a motor vehicle owned by an individual unless the owner
1818 provides proof that the owner holds a driver's license issued under
1919 Chapter 521 or a commercial driver's license issued under Chapter
2020 522 that is valid at the time the application for registration is
2121 presented to the county assessor-collector.
2222 (b) The department shall by rule prescribe the form of proof
2323 acceptable under this section.
2424 (c) A county assessor-collector is not liable to any person
2525 for refusing to register a motor vehicle because of the person's
2626 failure to submit proof that the person holds a currently valid
2727 driver's license issued under Chapter 521 or a currently valid
2828 commercial driver's license issued under Chapter 522.
2929 (d) This section does not apply to:
3030 (1) a vehicle owned by an individual 85 years of age or
3131 older;
3232 (2) a vehicle owned by a person with a disability, as
3333 defined by Section 3, Americans With Disabilities Act of 1990 (42
3434 U.S.C. Section 12102);
3535 (3) a vehicle owned by a nonresident who holds a
3636 driver's license recognized under Section 521.030; or
3737 (4) a vehicle registered under Section 501.0234.
3838 SECTION 2. The change in law made by this Act applies only
3939 to an application for registration submitted to a county
4040 assessor-collector on or after the effective date of this Act. An
4141 application submitted to a county assessor-collector before the
4242 effective date of this Act is covered by the law in effect on the
4343 date the application was submitted, and that law is continued in
4444 effect for that purpose.
4545 SECTION 3. This Act takes effect September 1, 2011.
