| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter D, Chapter 502, Transportation Code, |
|---|
| 14 | 14 | | is amended by adding Section 502.1536 to read as follows: |
|---|
| 15 | 15 | | Sec. 502.1536. EVIDENCE OF DRIVER'S LICENSE. (a) Except as |
|---|
| 16 | 16 | | provided by Subsection (d), a county assessor-collector may not |
|---|
| 17 | 17 | | register a motor vehicle owned by an individual unless the owner |
|---|
| 18 | 18 | | provides proof that the owner holds a driver's license issued under |
|---|
| 19 | 19 | | Chapter 521 or a commercial driver's license issued under Chapter |
|---|
| 20 | 20 | | 522 that is valid at the time the application for registration is |
|---|
| 21 | 21 | | presented to the county assessor-collector. |
|---|
| 22 | 22 | | (b) The department shall by rule prescribe the form of proof |
|---|
| 23 | 23 | | acceptable under this section. |
|---|
| 24 | 24 | | (c) A county assessor-collector is not liable to any person |
|---|
| 25 | 25 | | for refusing to register a motor vehicle because of the person's |
|---|
| 26 | 26 | | failure to submit proof that the person holds a currently valid |
|---|
| 27 | 27 | | driver's license issued under Chapter 521 or a currently valid |
|---|
| 28 | 28 | | commercial driver's license issued under Chapter 522. |
|---|
| 29 | 29 | | (d) This section does not apply to: |
|---|
| 30 | 30 | | (1) a vehicle owned by an individual 85 years of age or |
|---|
| 31 | 31 | | older; |
|---|
| 32 | 32 | | (2) a vehicle owned by a person with a disability, as |
|---|
| 33 | 33 | | defined by Section 3, Americans With Disabilities Act of 1990 (42 |
|---|
| 34 | 34 | | U.S.C. Section 12102); |
|---|
| 35 | 35 | | (3) a vehicle owned by a nonresident who holds a |
|---|
| 36 | 36 | | driver's license recognized under Section 521.030; or |
|---|
| 37 | 37 | | (4) a vehicle registered under Section 501.0234. |
|---|
| 38 | 38 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 39 | 39 | | to an application for registration submitted to a county |
|---|
| 40 | 40 | | assessor-collector on or after the effective date of this Act. An |
|---|
| 41 | 41 | | application submitted to a county assessor-collector before the |
|---|
| 42 | 42 | | effective date of this Act is covered by the law in effect on the |
|---|
| 43 | 43 | | date the application was submitted, and that law is continued in |
|---|
| 44 | 44 | | effect for that purpose. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect September 1, 2011. |
