| 11 | 11 | | Environmental Quality. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 5.128, Water Code, is amended by |
|---|
| 14 | 14 | | amending Subsection (a) and adding Subsections (a-1), (a-2), and |
|---|
| 15 | 15 | | (a-3) to read as follows: |
|---|
| 16 | 16 | | (a) The commission shall encourage the use of electronic |
|---|
| 17 | 17 | | reporting through the Internet, to the extent practicable, for |
|---|
| 18 | 18 | | reports required by the commission. Notwithstanding any other law, |
|---|
| 19 | 19 | | the commission may[: |
|---|
| 20 | 20 | | [(1)] adjust fees as necessary to encourage electronic |
|---|
| 21 | 21 | | reporting and the use of the commission's electronic document |
|---|
| 22 | 22 | | receiving system. An electronic report must be submitted in a |
|---|
| 23 | 23 | | format prescribed by the commission. The commission may consult |
|---|
| 24 | 24 | | with the Department of Information Resources on developing a simple |
|---|
| 25 | 25 | | format for use in implementing this subsection. |
|---|
| 26 | 26 | | (a-1) Notwithstanding any other law, the commission may[; |
|---|
| 27 | 27 | | and |
|---|
| 28 | 28 | | [(2)] utilize electronic means of transmission of |
|---|
| 29 | 29 | | information, including notices, orders, and decisions issued or |
|---|
| 30 | 30 | | sent by the commission. |
|---|
| 31 | 31 | | (a-2) The commission shall utilize electronic means of |
|---|
| 32 | 32 | | transmission for any notice issued or sent by the commission to a |
|---|
| 33 | 33 | | state senator or representative, unless the senator or |
|---|
| 34 | 34 | | representative has requested to receive notice by mail. |
|---|
| 35 | 35 | | (a-3) If the notice issued or sent under Subsection (a-2) |
|---|
| 36 | 36 | | concerns a permit for a facility, the notice must include an |
|---|
| 37 | 37 | | Internet link to an electronic map indicating the location of the |
|---|
| 38 | 38 | | facility. |
|---|
| 39 | 39 | | SECTION 2. This Act takes effect September 1, 2011. |
