77 relating to toll project information provided by the Texas
88 Department of Transportation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 228.004, Transportation Code, is amended
1111 to read as follows:
1212 Sec. 228.004. [PROMOTION OF] TOLL PROJECT INFORMATION. (a)
1313 The department may, notwithstanding Chapter 2113, Government Code:
1414 (1) [,] engage in marketing, advertising, and other
1515 activities to provide information relating to:
1616 (A) the status of pending or ongoing [promote the
1717 development and use of] toll projects; or
1818 (B) the use and availability of toll tags or
1919 other toll-related resources available to the public; and
2020 (2) [may] enter into contracts or agreements necessary
2121 to procure marketing, advertising, or informational [other
2222 promotional] services from outside service providers to provide the
2323 information described by Subdivision (1).
2424 (b) This section does not authorize the department to engage
2525 in marketing, advertising, or other activities for the purpose of
2626 influencing public opinion about the use of toll roads or the use of
2727 tolls as a financial mechanism or promoting or advocating for the
2828 benefits of toll roads.
2929 SECTION 2. The change in law made by this Act applies only
3030 to a contract or agreement entered into or renewed under Section
3131 228.004, Transportation Code, on or after the effective date of
3232 this Act. A contract or agreement entered into or renewed under
3333 that section before the effective date of this Act is governed by
3434 the law in effect immediately before that date, and that law is
3535 continued in effect for that purpose.
3636 SECTION 3. This Act takes effect September 1, 2011.
