| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 228.004, Transportation Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | Sec. 228.004. [PROMOTION OF] TOLL PROJECT INFORMATION. (a) |
|---|
| 13 | 13 | | The department may, notwithstanding Chapter 2113, Government Code: |
|---|
| 14 | 14 | | (1) [,] engage in marketing, advertising, and other |
|---|
| 15 | 15 | | activities to provide information relating to: |
|---|
| 16 | 16 | | (A) the status of pending or ongoing [promote the |
|---|
| 17 | 17 | | development and use of] toll projects; or |
|---|
| 18 | 18 | | (B) the use and availability of toll tags or |
|---|
| 19 | 19 | | other toll-related resources available to the public; and |
|---|
| 20 | 20 | | (2) [may] enter into contracts or agreements necessary |
|---|
| 21 | 21 | | to procure marketing, advertising, or informational [other |
|---|
| 22 | 22 | | promotional] services from outside service providers to provide the |
|---|
| 23 | 23 | | information described by Subdivision (1). |
|---|
| 24 | 24 | | (b) This section does not authorize the department to engage |
|---|
| 25 | 25 | | in marketing, advertising, or other activities for the purpose of |
|---|
| 26 | 26 | | influencing public opinion about the use of toll roads or the use of |
|---|
| 27 | 27 | | tolls as a financial mechanism or promoting or advocating for the |
|---|
| 28 | 28 | | benefits of toll roads. |

| 29 | 29 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 30 | 30 | | to a contract or agreement entered into or renewed under Section |
|---|
| 31 | 31 | | 228.004, Transportation Code, on or after the effective date of |
|---|
| 32 | 32 | | this Act. A contract or agreement entered into or renewed under |
|---|
| 33 | 33 | | that section before the effective date of this Act is governed by |
|---|
| 34 | 34 | | the law in effect immediately before that date, and that law is |
|---|
| 35 | 35 | | continued in effect for that purpose. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2011. |
