| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter D, Chapter 33, Education Code, is |
|---|
| 13 | 13 | | amended by adding Section 33.094 to read as follows: |
|---|
| 14 | 14 | | Sec. 33.094. FOOTBALL HELMET SAFETY REQUIREMENTS. (a) A |
|---|
| 15 | 15 | | school district may not use a football helmet that is 16 years old |
|---|
| 16 | 16 | | or older in the district's football program. |
|---|
| 17 | 17 | | (b) A school district shall ensure that each football helmet |
|---|
| 18 | 18 | | used in the district's football program that is 10 years old or |
|---|
| 19 | 19 | | older is reconditioned at least once every two years. |
|---|
| 20 | 20 | | (c) A school district shall maintain and make available to |
|---|
| 21 | 21 | | parents of students enrolled in the district documentation |
|---|
| 22 | 22 | | indicating the age of each football helmet used in the district's |
|---|
| 23 | 23 | | football program and the dates on which each helmet is |
|---|
| 24 | 24 | | reconditioned. |
|---|
| 25 | 25 | | (d) The University Interscholastic League may adopt rules |
|---|
| 26 | 26 | | necessary to implement this section, provided that the rules must |
|---|
| 27 | 27 | | be approved by the commissioner in accordance with Section |
|---|
| 28 | 28 | | 33.083(b). |

| 29 | 29 | | SECTION 2. This Act applies beginning with the 2012-2013 |
|---|
| 30 | 30 | | school year. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2011. |
