99 AN ACT
1010 relating to football helmet safety requirements in public schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter D, Chapter 33, Education Code, is
1313 amended by adding Section 33.094 to read as follows:
1414 Sec. 33.094. FOOTBALL HELMET SAFETY REQUIREMENTS. (a) A
1515 school district may not use a football helmet that is 16 years old
1616 or older in the district's football program.
1717 (b) A school district shall ensure that each football helmet
1818 used in the district's football program that is 10 years old or
1919 older is reconditioned at least once every two years.
2020 (c) A school district shall maintain and make available to
2121 parents of students enrolled in the district documentation
2222 indicating the age of each football helmet used in the district's
2323 football program and the dates on which each helmet is
2424 reconditioned.
2525 (d) The University Interscholastic League may adopt rules
2626 necessary to implement this section, provided that the rules must
2727 be approved by the commissioner in accordance with Section
2828 33.083(b).
2929 SECTION 2. This Act applies beginning with the 2012-2013
3030 school year.
3131 SECTION 3. This Act takes effect September 1, 2011.
