99 relating to cognitive-linguistic or neurocognitive assessments of
1010 participants in extracurricular athletic activities sponsored or
1111 sanctioned by the University Interscholastic League.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter D, Chapter 33, Education Code, is
1414 amended by adding Section 33.093 to read as follows:
1515 Sec. 33.093. COGNITIVE-LINGUISTIC OR NEUROCOGNITIVE
1616 ASSESSMENTS OF PARTICIPANTS IN EXTRACURRICULAR ATHLETIC
1717 ACTIVITIES. (a) For purposes of this section, only the following
1818 persons are appropriately licensed or certified health care
1919 professionals:
2020 (1) a physician licensed under Subtitle B, Title 3,
2121 Occupations Code;
2222 (2) a physician assistant licensed under Chapter 204,
2323 Occupations Code;
2424 (3) an advanced practice nurse licensed under Chapter
2525 301, Occupations Code;
2626 (4) a speech-language pathologist licensed under
2727 Chapter 401, Occupations Code, or certified as a speech-language
2828 pathologist by the Texas Education Agency; and
2929 (5) an athletic trainer licensed under Chapter 451,
3030 Occupations Code.
3131 (b) Except as provided under Subsection (d), a school
3232 district must require a district student who is required under
3333 University Interscholastic League rule or policy to receive a
3434 physical examination before being allowed to participate in an
3535 athletic activity sponsored or sanctioned by the University
3636 Interscholastic League to also receive a cognitive-linguistic or
3737 neurocognitive assessment performed by an appropriately licensed
3838 or certified health care professional and administered in
3939 accordance with current international consensus on concussion
4040 management before the district allows the student to participate in
4141 the activity, including a practice for the activity.
4242 (c) Except as provided under Subsection (d), a school
4343 district must require a district student who, after sustaining a
4444 concussion, is required under University Interscholastic League
4545 rule or policy to receive a physical examination or obtain medical
4646 approval before being allowed to resume participating in or
4747 practicing for an athletic activity sponsored or sanctioned by the
4848 University Interscholastic League to also obtain a
4949 cognitive-linguistic or neurocognitive assessment performed by an
5050 appropriately licensed or certified health care professional and
5151 administered in accordance with current international consensus on
5252 concussion management before the district allows the student to
5353 resume participating in or practicing for the activity. The
5454 results of the cognitive-linguistic or neurocognitive assessment
5555 must be considered as a factor in determining whether the student is
5656 to be allowed to resume participating in or practicing for the
5757 activity.
5858 (d) A school district is not required to comply with
5959 Subsection (b) or (c), as applicable, if the board of trustees of
6060 the district, by majority vote, decides that it is in the best
6161 interests of district students not to comply with the subsection.
6262 (e) A school district may assist in coordinating the
6363 provision of a cognitive-linguistic or neurocognitive assessment
6464 required under this section. A district may pay the costs of the
6565 assessment and may recover those costs from the parent or guardian
6666 of a student or the student receiving the assessment.
6767 (f) This section does not create a cause of action or
6868 liability against an appropriately licensed or certified health
6969 care professional, a school district, or a district officer or
7070 employee for the injury or death of a student participating in or
7171 practicing for an athletic activity sponsored or sanctioned by the
7272 University Interscholastic League based on or in connection with
7373 the administration or evaluation of or reliance on a
7474 cognitive-linguistic or neurocognitive assessment or the decision
7575 not to administer, evaluate, or rely on such an assessment.
7676 (g) A school district shall maintain in a student's school
7777 records a copy of a cognitive-linguistic or neurocognitive
7878 assessment required under this section available to the district.
7979 (h) The University Interscholastic League shall adopt rules
8080 as necessary to administer this section, including rules
8181 establishing standards for a cognitive-linguistic or
8282 neurocognitive assessment required under this section. The league
8383 may consider recommendations of the league's medical advisory
8484 committee in establishing standards for a cognitive-linguistic or
8585 neurocognitive assessment.
8686 SECTION 2. This Act applies beginning with the 2012-2013
8787 school year.
8888 SECTION 3. This Act takes effect immediately if it receives
8989 a vote of two-thirds of all the members elected to each house, as
9090 provided by Section 39, Article III, Texas Constitution. If this
9191 Act does not receive the vote necessary for immediate effect, this
9292 Act takes effect September 1, 2011.
