99 AN ACT
1010 relating to verification of identity of applicants for benefits
1111 under and prevention of duplicate participation in the financial
1212 assistance and supplemental nutrition assistance programs.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter B, Chapter 31, Human Resources Code,
1515 is amended by adding Section 31.0326 to read as follows:
1616 Sec. 31.0326. VERIFICATION OF IDENTITY AND PREVENTION OF
1717 DUPLICATE PARTICIPATION. The Health and Human Services Commission
1818 shall use appropriate technology to:
1919 (1) confirm the identity of applicants for benefits
2020 under the financial assistance program; and
2121 (2) prevent duplicate participation in the program by
2222 a person.
2323 SECTION 2. Chapter 33, Human Resources Code, is amended by
2424 adding Section 33.0231 to read as follows:
2525 Sec. 33.0231. VERIFICATION OF IDENTITY AND PREVENTION OF
2626 DUPLICATE PARTICIPATION. The department shall use appropriate
2727 technology to:
2828 (1) confirm the identity of applicants for benefits
2929 under the supplemental nutrition assistance program; and
3030 (2) prevent duplicate participation in the program by
3131 a person.
3232 SECTION 3. Section 31.0325, Human Resources Code, is
3333 repealed.
3434 SECTION 4. If before implementing any provision of this Act
3535 a state agency determines that a waiver or authorization from a
3636 federal agency is necessary for implementation of that provision,
3737 the agency affected by the provision shall request the waiver or
3838 authorization and may delay implementing that provision until the
3939 waiver or authorization is granted.
4040 SECTION 5. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2011.
