| 14 | 14 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 15 | 15 | SECTION 1. Subchapter Z, Chapter 51, Education Code, is | |
| 16 | 16 | amended by adding Section 51.9091 to read as follows: | |
| 17 | 17 | Sec. 51.9091. REQUIRED NOTIFICATION OF FEDERAL STUDENT AND | |
| 18 | 18 | EXCHANGE VISITOR INFORMATION SYSTEM (SEVIS) REGARDING WITHDRAWAL | |
| 19 | 19 | OR NONATTENDANCE OF CERTAIN FOREIGN STUDENTS. A public institution | |
| 20 | 20 | of higher education that is certified by the United States | |
| 21 | 21 | secretary of homeland security to enroll a foreign student admitted | |
| 22 | 22 | into the United States under a nonimmigrant F or M visa shall | |
| 23 | 23 | promptly notify the federal Student and Exchange Visitor | |
| 24 | 24 | Information System (SEVIS) or a successor program if: | |
| 25 | 25 | (1) a student enrolled under an F or M visa withdraws | |
| 26 | 26 | from the institution or withdraws from all courses in which the | |
| 27 | 27 | student is enrolled; or | |
| 28 | 28 | (2) the institution dismisses a student enrolled under | |
| 29 | 29 | an F or M visa for nonattendance or takes any other official | |
| 30 | 30 | administrative action in regard to the student as a result of the | |
| 31 | 31 | student's nonattendance. | |
| 32 | 32 | SECTION 2. This Act takes effect September 1, 2011. |
