99 AN ACT
1010 relating to requiring public institutions of higher education to
1111 notify the federal Student and Exchange Visitor Information System
1212 (SEVIS) regarding the withdrawal or nonattendance of certain
1313 foreign students.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1616 amended by adding Section 51.9091 to read as follows:
1717 Sec. 51.9091. REQUIRED NOTIFICATION OF FEDERAL STUDENT AND
1818 EXCHANGE VISITOR INFORMATION SYSTEM (SEVIS) REGARDING WITHDRAWAL
1919 OR NONATTENDANCE OF CERTAIN FOREIGN STUDENTS. A public institution
2020 of higher education that is certified by the United States
2121 secretary of homeland security to enroll a foreign student admitted
2222 into the United States under a nonimmigrant F or M visa shall
2323 promptly notify the federal Student and Exchange Visitor
2424 Information System (SEVIS) or a successor program if:
2525 (1) a student enrolled under an F or M visa withdraws
2626 from the institution or withdraws from all courses in which the
2727 student is enrolled; or
2828 (2) the institution dismisses a student enrolled under
2929 an F or M visa for nonattendance or takes any other official
3030 administrative action in regard to the student as a result of the
3131 student's nonattendance.
3232 SECTION 2. This Act takes effect September 1, 2011.
