66 AN ACT
77 relating to eligibility to serve on the appraisal review board of an
88 appraisal district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 6.412(d) and (e), Tax Code, are amended
1111 to read as follows:
1212 (d) A person is ineligible to serve on the appraisal review
1313 board of an appraisal district established for a county having a
1414 population of more than 100,000 if the person:
1515 (1) [if the person:
1616 [(A) has served for all or part of three previous
1717 terms as a board member or auxiliary board member on the appraisal
1818 review board; or
1919 [(B)] is a former member of the board of
2020 directors, former officer, or former employee of the appraisal
2121 district; [or]
2222 (2) [if the person] served as a member of the governing
2323 body or officer of a taxing unit for which the appraisal district
2424 appraises property, until the fourth anniversary of the date the
2525 person ceased to be a member or officer; or
2626 (3) [if the person] has ever appeared before the
2727 appraisal review board for compensation.
2828 (e) A [In an appraisal district established for a county
2929 having a population of 100,000 or less, a] person who has served for
3030 all or part of three consecutive terms as a board member [or
3131 auxiliary board member] on an [the] appraisal review board is
3232 ineligible to serve on the appraisal review board during a term that
3333 begins on the next January 1 following the third of those
3434 consecutive terms.
3535 SECTION 2. Section 6.412(f), Tax Code, is repealed.
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2011.
