99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to compensatory time accrued by a correctional officer
1212 employed by the Texas Department of Criminal Justice.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 659.015, Government Code, is amended by
1515 amending Subsection (g) and adding Subsection (k) to read as
1616 follows:
1717 (g) Except as provided by Subsection (k), compensatory
1818 [Compensatory] time off to which an employee is entitled under
1919 Subsection (f) must be taken during the 12-month period following
2020 the end of the workweek in which the compensatory time was accrued
2121 or it lapses. An employee may not be paid for that compensatory
2222 time, except as provided by this subsection and Subsections (i) and
2323 (j). An employee of an institution of higher education as defined
2424 by Section 61.003, Education Code, or an employee engaged in a
2525 public safety activity, including highway construction and
2626 maintenance or an emergency response activity, may be paid at the
2727 employee's regular rate of pay for that compensatory time if the
2828 employer determines that taking the compensatory time off would
2929 disrupt normal teaching, research, or other critical functions.
3030 (k) Compensatory time off to which a correctional officer
3131 employed by the Texas Department of Criminal Justice is entitled
3232 under Subsection (f) must be taken during the 24-month period
3333 following the end of the workweek in which the compensatory time was
3434 accrued or it lapses.
3535 SECTION 2. This Act takes effect September 1, 2011.
