55 CONCURRENT RESOLUTION
66 WHEREAS, The regulation and oversight of the health insurance
77 market are powers that have traditionally and historically been
88 reserved for state government; and
99 WHEREAS, Through their direct knowledge of market
1010 conditions, state legislatures are uniquely positioned to respond
1111 quickly and efficiently to the needs of local constituents; over
1212 the years, this state-based system of regulation has served all
1313 interests well; and
1414 WHEREAS, The United States Congress overstepped its
1515 constitutional authority when it passed the Patient Protection and
1616 Affordable Care Act on March 21, 2010; the Act encroaches on the
1717 sovereignty of states, forcing them to spend billions of additional
1818 dollars on entitlement programs; according to the Texas Health and
1919 Human Services Commission, the new federal Medicaid standards
2020 imposed by the Act will double the number of recipients and require
2121 Texas taxpayers to spend an additional $24.3 billion over a 10-year
2222 period; moreover, by shifting substantial administrative
2323 responsibilities to the states, the new law will require that state
2424 employees and agencies devote enormous amounts of time and
2525 resources to implementation; and
2626 WHEREAS, The Act also infringes on the liberty of individuals
2727 by mandating that all citizens and legal residents of the United
2828 States obtain qualifying health care coverage or pay a tax penalty;
2929 this mandate exceeds the powers of the federal government under
3030 Article I of the United States Constitution and violates the Tenth
3131 Amendment; and
3232 WHEREAS, The Patient Protection and Affordable Care Act not
3333 only is unconstitutional, its implementation will endanger
3434 economic stability by adding billions of dollars to the already
3535 staggering national debt; now, therefore, be it
3636 RESOLVED, That the 82nd Legislature of the State of Texas
3737 hereby express its opposition to the Patient Protection and
3838 Affordable Care Act; and, be it further
3939 RESOLVED, That the Texas secretary of state forward official
4040 copies of this resolution to the president of the United States, to
4141 the president of the Senate and the speaker of the House of
4242 Representatives of the United States Congress, and to all the
4343 members of the Texas delegation to Congress with the request that
4444 this resolution be entered in the Congressional Record as a
4545 memorial to the Congress of the United States of America.
