8	8	HOUSE CONCURRENT RESOLUTION
9	9	WHEREAS, The Texas Legislature for each of the last 14
10	10	regular sessions has adopted a concurrent resolution authorizing
11	11	the creation and appointment of joint interim legislative study
12	12	committees by the lieutenant governor and speaker of the house of
13	13	representatives; and
14	14	WHEREAS, Renewal of the prior authorizations to the presiding
15	15	officers enables the legislature to address and study issues that
16	16	remain unresolved on sine die adjournment or that emerge subsequent
17	17	to that time; and
18	18	WHEREAS, It is also desirable to adopt by resolution various
19	19	rules and policies regarding the operation of joint committees to
20	20	supplement, and reconcile differences between, the senate and house
21	21	rules of procedure; now, therefore, be it
22	22	RESOLVED, That the 82nd Legislature of the State of Texas
23	23	hereby authorize the lieutenant governor and speaker of the house
24	24	of representatives to create by mutual agreement such joint
25	25	committees as they consider necessary during the term of this
26	26	legislature; and, be it further
27	27	RESOLVED, That each joint committee created pursuant to this
28	28	resolution be composed of such combination of legislators, state
29	29	officials, or citizen members as shall be determined mutually by
30	30	the presiding officers of each house; and, be it further
31	31	RESOLVED, That on the request of the presiding officers, the
32	32	governor may appoint members to a joint committee created pursuant
33	33	to this resolution; and, be it further
34	34	RESOLVED, That the presiding officers issue for each
35	35	committee so created a joint proclamation identifying the issue or
36	36	issues to be studied and listing the committee membership or
37	37	describing the committee composition and that the proclamation be
38	38	filed with the secretary of the senate and the chief clerk of the
39	39	house of representatives; and, be it further
40	40	RESOLVED, That the presiding officers designate jointly a
41	41	chair, or designate alternatively two co-chairs, from among the
42	42	committee membership; and, be it further
43	43	RESOLVED, That the chair or co-chairs, acting jointly and
44	44	within four weeks of the proclamation, prepare and present to the
45	45	presiding officers a proposal for budget and staffing; and, be it
46	46	further
47	47	RESOLVED, That the chair or co-chairs be directed to use to
48	48	the greatest extent possible the existing staff and administrative
49	49	resources of committee members, standing committees, officers of
50	50	the senate and house, and legislative service agencies; and, be it
51	51	further
52	52	RESOLVED, That the presiding officers jointly review each
53	53	budget and staffing proposal, adopt budgetary and staffing
54	54	allocations, and determine the manner in which each joint committee
55	55	is to be funded; and, be it further
56	56	RESOLVED, That the joint committee chair, or the co-chairs
57	57	acting by mutual agreement, have authority to create and appoint
58	58	subcommittees or affiliated advisory panels and to designate
59	59	respective chairs for each, contingent on the advance approval of
60	60	the presiding officers for the creation and appointment of
61	61	subcommittees or advisory panels containing membership external to
62	62	the committee; and, be it further
63	63	RESOLVED, That each joint committee, and its subcommittees
64	64	and advisory panels, convene at the call of its chair or co-chairs;
65	65	provided that no joint committee, nor its subcommittees or advisory
66	66	panels, shall convene in a public hearing or other meeting for the
67	67	transaction of business unless public notice has been posted by its
68	68	chair or co-chairs at the locations specified by the senate and
69	69	house rules of procedure for posting of notice of standing
70	70	committee meetings at least five calendar days in advance of the
71	71	hearing or meeting; and, be it further
72	72	RESOLVED, That the preceding clause be construed, for
73	73	purposes of Section 551.046, Government Code, as a joint rule of the
74	74	senate and house of representatives controlling the posting of
75	75	notice for joint committees, and their subcommittees and advisory
76	76	panels, in lieu of required posting with the secretary of state;
77	77	and, be it further
78	78	RESOLVED, That each joint committee have authority to issue
79	79	process as provided in Sections 301.024-301.027, Government Code,
80	80	provided that any motion for the issuance of process must receive
81	81	the record vote of at least two-thirds of those present and voting,
82	82	a quorum being present; and, be it further
83	83	RESOLVED, That each joint committee be entitled to accept
84	84	grants and donations as provided by Subsections (b) and (c),
85	85	Section 301.032, Government Code, and that, on expiration of a
86	86	joint committee, any unexpended funds remaining from a grant or
87	87	donation be transferred in equal proportions to the accounts of the
88	88	senate and house of representatives unless otherwise provided by
89	89	the grantor or donor; and, be it further
90	90	RESOLVED, That each joint committee, except as modified by or
91	91	pursuant to this resolution, have all other powers and duties
92	92	provided to special committees by Subchapter B, Chapter 301,
93	93	Government Code, and the senate and house rules of procedure; and,
94	94	be it further
95	95	RESOLVED, That the operating accounts for each joint
96	96	committee created pursuant to this resolution and any grants and
97	97	donations that such committee may receive be administered by the
98	98	accounting and purchasing sections of the Texas Legislative
99	99	Council; and, be it further
100	100	RESOLVED, That the Texas Legislative Council accounting and
101	101	purchasing sections prepare, under the guidance of the presiding
102	102	officers, a manual of procedures for joint committees and other
103	103	entities created by the legislature for which funds are to be
104	104	administered by the Texas Legislative Council establishing
105	105	requirements as to printing needs, accounting procedures, ultimate
106	106	disposition of records, and other administrative and financial
107	107	matters; and, be it further
108	108	RESOLVED, That citizen members appointed by the lieutenant
109	109	governor or speaker of the house of representatives to joint
110	110	committees created pursuant to this resolution be reimbursed from
111	111	funds appropriated to the Texas Legislative Council for expenses of
112	112	transportation, meals, lodging, and incidentals for travel on
113	113	official committee business, at rates established by the joint
114	114	chairs of the Texas Legislative Council consistent with provisions
115	115	of the General Appropriations Act; and, be it further
116	116	RESOLVED, That citizen members appointed by the governor to
117	117	joint committees created pursuant to this resolution be reimbursed
118	118	from funds appropriated to the office of the governor for expenses
119	119	of travel on official committee business, at rates established by
120	120	the joint chairs of the Texas Legislative Council consistent with
121	121	provisions of the General Appropriations Act; and, be it further
122	122	RESOLVED, That citizen members appointed by the lieutenant
123	123	governor to senate select committees and citizen members appointed
124	124	by the speaker of the house of representatives to house committees
125	125	expanded or created under House Rule 4, Sections 24, 57, and 58,
126	126	when engaged in travel on official committee business, be
127	127	reimbursed for (1) transportation expenses at the same rates as
128	128	authorized for state employees by the General Appropriations Act,
129	129	and (2) actual expenses for meals, lodging, and incidentals,
130	130	subject to any maximum reimbursement limitations for meals and
131	131	lodging set by the Senate Administration Committee for senate
132	132	select committees and by the Committee on House Administration for
133	133	house select committees; and, be it further
134	134	RESOLVED, That the Texas Legislative Council be authorized to
135	135	reimburse the senate and house of representatives for expenses
136	136	incurred by members of the senate and house for transportation,
137	137	meals, lodging, and incidentals for travel on official business of
138	138	joint committees created pursuant to this resolution; and, be it
139	139	further
140	140	RESOLVED, That the final report of each joint committee be
141	141	approved by a majority of the voting membership of the committee;
142	142	dissenting voting members may attach statements to the final report
143	143	subject to any limitations specified in the rules adopted by the
144	144	committee; and, be it further
145	145	RESOLVED, That each joint committee created pursuant to this
146	146	resolution expire on January 8, 2013, or an earlier date specified
147	147	in the proclamation creating the committee.
