88 A JOINT RESOLUTION
99 proposing a constitutional amendment relating to an individual's or
1010 a religious organization's freedom of religion.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 6, Article I, Texas Constitution, is
1313 amended to read as follows:
1414 Sec. 6. (a) All men have a natural and indefeasible right
1515 to worship Almighty God according to the dictates of their own
1616 consciences. No man shall be compelled to attend, erect or support
1717 any place of worship, or to maintain any ministry against his
1818 consent. No human authority ought, in any case whatever, to control
1919 or interfere with the rights of conscience in matters of religion,
2020 and no preference shall ever be given by law to any religious
2121 society or mode of worship.
2222 (b) Government may not, directly, indirectly, or
2323 incidentally, substantially burden an individual's or a religious
2424 organization's conduct that is based on a sincerely held religious
2525 belief, unless the government is:
2626 (1) acting to further a compelling governmental
2727 interest; and
2828 (2) using the least restrictive available means to do
2929 so.
3030 (c) But it shall be the duty of the Legislature to pass such
3131 laws as may be necessary to protect equally every religious
3232 denomination in the peaceable enjoyment of its own mode of public
3333 worship.
3434 SECTION 2. This proposed constitutional amendment shall be
3535 submitted to the voters at an election to be held November 8, 2011.
3636 The ballot shall be printed to provide for voting for or against the
3737 proposition: "The constitutional amendment relating to an
3838 individual's or a religious organization's freedom of religion."
