99 AN ACT
1010 relating to the annexation by certain conservation and reclamation
1111 districts of noncontiguous land in another county.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter J, Chapter 49, Water Code, is amended
1414 by adding Section 49.3021 to read as follows:
1515 Sec. 49.3021. COUNTY CONSENT FOR CERTAIN ANNEXATIONS.
1616 Before a district may annex land that is noncontiguous to the
1717 district and located wholly or partly in a county other than the
1818 county or counties in which the district is located before the
1919 annexation, the county commissioners of the county in which the
2020 land to be annexed is located must consent by order or resolution to
2121 the proposed annexation.
2222 SECTION 2. Section 49.3021, Water Code, as added by this
2323 Act, applies only to a petition requesting the annexation of land
2424 received by a district board under Section 49.301 or 49.302, Water
2525 Code, on or after the effective date of this Act. A petition
2626 requesting the annexation of land received by a district board
2727 under Section 49.301 or 49.302, Water Code, before the effective
2828 date of this Act is governed by the law in effect on the date the
2929 petition is received, and that law is continued in effect for that
3030 purpose.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2011.
