| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter J, Chapter 49, Water Code, is amended |
|---|
| 14 | 14 | | by adding Section 49.3021 to read as follows: |
|---|
| 15 | 15 | | Sec. 49.3021. COUNTY CONSENT FOR CERTAIN ANNEXATIONS. |
|---|
| 16 | 16 | | Before a district may annex land that is noncontiguous to the |
|---|
| 17 | 17 | | district and located wholly or partly in a county other than the |
|---|
| 18 | 18 | | county or counties in which the district is located before the |
|---|
| 19 | 19 | | annexation, the county commissioners of the county in which the |
|---|
| 20 | 20 | | land to be annexed is located must consent by order or resolution to |
|---|
| 21 | 21 | | the proposed annexation. |

| 22 | 22 | | SECTION 2. Section 49.3021, Water Code, as added by this |
|---|
| 23 | 23 | | Act, applies only to a petition requesting the annexation of land |
|---|
| 24 | 24 | | received by a district board under Section 49.301 or 49.302, Water |
|---|
| 25 | 25 | | Code, on or after the effective date of this Act. A petition |
|---|
| 26 | 26 | | requesting the annexation of land received by a district board |
|---|
| 27 | 27 | | under Section 49.301 or 49.302, Water Code, before the effective |
|---|
| 28 | 28 | | date of this Act is governed by the law in effect on the date the |
|---|
| 29 | 29 | | petition is received, and that law is continued in effect for that |
|---|
| 30 | 30 | | purpose. |

| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2011. |
