77 relating to an appraisal and professional development system for
88 public school principals.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 21.354, Education Code,
1111 is amended to read as follows:
1212 Sec. 21.354. APPRAISAL OF CERTAIN ADMINISTRATORS.
1313 SECTION 2. Section 21.354, Education Code, is amended by
1414 adding Subsection (a-1) to read as follows:
1515 (a-1) This section does not apply to the appraisal of the
1616 performance of a principal.
1717 SECTION 3. Subchapter H, Chapter 21, Education Code, is
1818 amended by adding Section 21.3541 to read as follows:
1919 Sec. 21.3541. APPRAISAL AND PROFESSIONAL DEVELOPMENT
2020 SYSTEM FOR PRINCIPALS. (a) The commissioner by rule shall
2121 establish and shall administer a comprehensive appraisal and
2222 professional development system for principals.
2323 (b) The commissioner may establish a consortium of
2424 nationally recognized experts on educational leadership and policy
2525 to:
2626 (1) assist the commissioner in effectively
2727 researching and developing the comprehensive appraisal and
2828 professional development system described by Subsection (a); and
2929 (2) evaluate relevant research and practices and make
3030 recommendations to the commissioner to improve the quality of the
3131 training, appraisal, professional development, and compensation of
3232 principals.
3333 (c) If the commissioner establishes the consortium, the
3434 commissioner shall select a presiding officer of the consortium.
3535 The presiding officer:
3636 (1) must be an expert on educational leadership and
3737 policy;
3838 (2) must have a demonstrated ability to lead a
3939 statewide school leadership reform initiative; and
4040 (3) may not be employed by a school district in this
4141 state.
4242 (d) The commissioner shall establish school leadership
4343 standards and a set of indicators of successful school leadership
4444 to align with the training, appraisal, and professional development
4545 of principals.
4646 (e) In carrying out the commissioner's powers and duties
4747 under this section, the commissioner may use only money available
4848 from private sources that may be used for that purpose.
4949 (f) In appraising principals, each school district shall
5050 use either:
5151 (1) the appraisal system and school leadership
5252 standards and indicators developed or established by the
5353 commissioner under this section; or
5454 (2) an appraisal process and performance criteria:
5555 (A) developed by the district in consultation
5656 with the district-level and campus-level committees established
5757 under Section 11.251; and
5858 (B) adopted by the board of trustees.
5959 (g) Each school district shall appraise each principal
6060 annually.
6161 (h) Not later than December 1 of 2012 and 2014, the
6262 commissioner shall submit a written report to the governor,
6363 lieutenant governor, speaker of the house of representatives, and
6464 presiding officer of each standing legislative committee with
6565 primary jurisdiction over public education of:
6666 (1) any action taken under this section; and
6767 (2) any recommendations for legislative action
6868 concerning the training, appraisal, professional development, or
6969 compensation of principals.
7070 (i) Subsection (h) and this subsection expire January 1,
7171 2015.
7272 SECTION 4. Section 21.451, Education Code, is amended by
7373 amending Subsections (a) through (d) and adding Subsection (a-1) to
7474 read as follows:
7575 (a) The staff development provided by a school district to
7676 an educator other than a principal must be:
7777 (1) conducted in accordance with standards developed
7878 by the district; and
7979 (2) designed to improve education in the district.
8080 (a-1) Section 21.3541 and rules adopted under that section
8181 govern the professional development provided to a principal.
8282 (b) The staff development described by Subsection (a) must
8383 be predominantly campus-based, related to achieving campus
8484 performance objectives established under Section 11.253, and
8585 developed and approved by the campus-level committee established
8686 under Section 11.251.
8787 (c) For staff development under Subsection (a), a [A] school
8888 district may use district-wide staff development developed and
8989 approved through the district-level decision process under Section
9090 11.251.
9191 (d) The staff development:
9292 (1) may include training in:
9393 (A) technology;
9494 (B) conflict resolution; and
9595 (C) discipline strategies, including classroom
9696 management, district discipline policies, and the student code of
9797 conduct adopted under Section 37.001 and Chapter 37; and
9898 (2) subject to Subsection (e) and to Section 21.3541
9999 and rules adopted under that section, must include training based
100100 on scientifically based research, as defined by Section 9101, No
101101 Child Left Behind Act of 2001 (20 U.S.C. Section 7801), that:
102102 (A) relates to instruction of students with
103103 disabilities; and
104104 (B) is designed for educators who work primarily
105105 outside the area of special education.
106106 SECTION 5. Subsection (e), Section 21.354, Education Code,
107107 is repealed.
108108 SECTION 6. Notwithstanding Sections 21.354 and 21.451,
109109 Education Code, as amended by this Act, until an appraisal and
110110 professional development system for principals under Section
111111 21.3541, Education Code, as added by this Act, is implemented,
112112 public school principals shall be appraised under Section 21.354,
113113 Education Code, as that section existed before amendment by this
114114 Act, and the staff development of principals is governed by Section
115115 21.451, Education Code, as that section existed before amendment by
116116 this Act.
117117 SECTION 7. This Act takes effect immediately if it receives
118118 a vote of two-thirds of all the members elected to each house, as
119119 provided by Section 39, Article III, Texas Constitution. If this
120120 Act does not receive the vote necessary for immediate effect, this
121121 Act takes effect September 1, 2011.
