| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subdivision (8), Section 271.003, Local | |
| 11 | 11 | Government Code, is amended to read as follows: | |
| 12 | 12 | (8) "Personal property" includes appliances, | |
| 13 | 13 | equipment, facilities, and furnishings, or an interest in personal | |
| 14 | 14 | property, whether movable or fixed, considered by the governing | |
| 15 | 15 | body of the governmental agency to be necessary, useful, or | |
| 16 | 16 | appropriate to one or more purposes of the governmental agency. The | |
| 17 | 17 | term includes all materials and labor incident to the installation | |
| 18 | 18 | of that personal property. The term includes electricity. The term | |
| 19 | 19 | does not include real property. | |
| 20 | 20 | SECTION 2. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2011. |
