1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to energy and efficiency conservation programs
1313 administered by the Public Utility Commission of Texas.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subsection (d), Section 39.905, Utilities Code,
1616 is amended to read as follows:
1717 (d) The commission shall establish a procedure for
1818 reviewing and evaluating market-transformation program options
1919 described by this subsection and other options. In evaluating
2020 program options, the commission may consider the ability of a
2121 program option to reduce costs to customers through reduced demand,
2222 energy savings, and relief of congestion. Utilities may choose to
2323 implement any program option approved by the commission after its
2424 evaluation in order to satisfy the goal in Subsection (a),
2525 including:
2626 (1) energy-smart schools;
2727 (2) appliance retirement and recycling;
2828 (3) air conditioning system tune-ups;
2929 (4) the use of trees or other landscaping for energy
3030 efficiency;
3131 (5) customer energy management and demand response
3232 programs;
3333 (6) high performance residential and commercial
3434 buildings that will achieve the levels of energy efficiency
3535 sufficient to qualify those buildings for federal tax incentives;
3636 (7) programs for customers who rent or lease their
3737 residence or commercial space;
3838 (8) programs providing energy monitoring equipment to
3939 customers that enable a customer to better understand the amount,
4040 price, and time of the customer's energy use;
4141 (9) energy audit programs for owners and other
4242 residents of single-family or multifamily residences and for small
4343 commercial customers;
4444 (10) net-zero energy new home programs;
4545 (11) solar thermal or solar electric programs; [and]
4646 (12) programs for using windows and other glazing
4747 systems, glass doors, and skylights in residential and commercial
4848 buildings that reduce solar gain by at least 30 percent from the
4949 level established for the federal Energy Star windows program; and
5050 (13) energy use programs with measurable and
5151 verifiable results that reduce energy consumption through
5252 behavioral changes that lead to efficient use patterns and
5353 practices.
5454 SECTION 2. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2011.
