77 relating to developing a developmental education plan for students
88 entering public institutions of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 61, Education Code, is
1111 amended by adding Section 61.07611 to read as follows:
1212 Sec. 61.07611. DEVELOPMENTAL EDUCATION PLAN; REPORT.
1313 (a) To serve students who require developmental education in an
1414 effective and cost-effective manner, the board shall develop a
1515 statewide plan for developmental education to be provided under
1616 Section 51.3062 that:
1717 (1) assigns primary responsibility for developmental
1818 education to public junior colleges, public state colleges, and
1919 public technical institutes; and
2020 (2) provides for using technology, to the greatest
2121 extent practicable consistent with best practices, to provide
2222 developmental education to students.
2323 (b) In developing the developmental education plan, the
2424 board shall:
2525 (1) research relevant issues related to developmental
2626 education;
2727 (2) study and develop best practices for successful
2828 developmental education programs, including through use of pilot
2929 programs; and
3030 (3) assess various methods of providing developmental
3131 education to students to determine which methods, if any, should be
3232 implemented on a statewide basis.
3333 (c) Developmental education under the plan must include:
3434 (1) technological delivery of developmental education
3535 courses that allows students to complete course work;
3636 (2) diagnostic assessments to determine a student's
3737 specific educational needs to allow for appropriate developmental
3838 instruction;
3939 (3) modular developmental education course materials;
4040 (4) use of tutors and instructional aides to
4141 supplement developmental education course instruction as needed
4242 for particular students;
4343 (5) an internal monitoring mechanism to identify a
4444 student's area of academic difficulty;
4545 (6) periodic updates of developmental education
4646 course materials; and
4747 (7) assessments after completion of a developmental
4848 education course to determine a student's readiness to enroll in
4949 freshman-level academic courses.
5050 (d) The developmental education plan must provide for:
5151 (1) ongoing training for developmental education
5252 program faculty members, tutors, and instructional aides at the
5353 institutions or other locations where those persons provide
5454 instruction; and
5555 (2) ongoing research and improvement of appropriate
5656 developmental education programs, including participation by a
5757 group of institution of higher education faculty members selected
5858 by the board, to:
5959 (A) monitor results of the programs;
6060 (B) identify successful and unsuccessful program
6161 components; and
6262 (C) identify possible solutions to program
6363 problems.
6464 (e) Not later than December 1, 2012, the board shall submit
6565 to the governor, lieutenant governor, speaker of the house of
6666 representatives, and presiding officer of each legislative
6767 standing committee with primary jurisdiction over higher education
6868 a report concerning the initial development of the developmental
6969 education plan under this section, including any recommendations
7070 for redesign or reassignment among institutions of higher education
7171 of existing programs or implementation of new programs and, if
7272 appropriate, recommendations for legislation. This subsection
7373 expires January 1, 2013.
7474 SECTION 2. This Act takes effect immediately if it receives
7575 a vote of two-thirds of all the members elected to each house, as
7676 provided by Section 39, Article III, Texas Constitution. If this
7777 Act does not receive the vote necessary for immediate effect, this
7878 Act takes effect September 1, 2011.
