1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to transparency and propagation of information regarding
1313 personal automobile and residential property insurance rates,
1414 policies, and complaints.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. This Act shall be known as the Texas Insurance
1717 Consumer Awareness and Affordability Act.
1818 SECTION 2. Subchapter B, Chapter 32, Insurance Code, is
1919 amended by adding Sections 32.024 and 32.025 to read as follows:
2020 Sec. 32.024. TEXAS RESIDENTIAL PROPERTY INSURANCE STUDY.
2121 (a) In this section, "residential property insurance" means
2222 insurance against loss to real or tangible personal property at a
2323 fixed location that is provided through a homeowners insurance
2424 policy or residential fire and allied lines insurance policy.
2525 (b) The department and the office of public insurance
2626 counsel shall study:
2727 (1) residential property insurance rates in this
2828 state;
2929 (2) regulatory changes with the potential to lower
3030 residential property insurance rates over time in a sustainable
3131 manner;
3232 (3) practices by individual companies that have the
3333 effect of lowering residential property insurance rates or
3434 increasing customer satisfaction over time in a sustainable manner;
3535 (4) other states' laws that have the effect of lowering
3636 residential property insurance rates over time in a sustainable
3737 manner;
3838 (5) the impact of weather events on residential
3939 property insurance rates in this state;
4040 (6) in an effort to identify practices that lower
4141 insurance rates, the similarities and differences between the
4242 residential property insurance market and the commercial property
4343 insurance market in this state;
4444 (7) industry practices and regulatory changes that
4545 encourage policyholders to learn more about the insurance market
4646 and to actively shop for insurance alternatives, and that overcome
4747 technological barriers facing certain consumers or groups of
4848 consumers;
4949 (8) industry practices and regulatory changes that
5050 encourage mid-level and small-level carriers to compete for
5151 increased market share and that attract new carriers to Texas;
5252 (9) the role of general economic factors such as
5353 inflation and changes in the costs of certain products and services
5454 in the setting of insurance rates;
5555 (10) the effects of fraud on insurance rates and
5656 strategies to reduce fraud in this state;
5757 (11) practices that increase efficiency and decrease
5858 administrative costs in the requests for information and data by
5959 the department and the conveyance of information and data by
6060 companies; and
6161 (12) the effect of the market cycle by which insurance
6262 costs and underwriting criteria change due to economic factors on
6363 the affordability and availability of insurance.
6464 (c) Not later than September 1, 2012, the department and the
6565 office of public insurance counsel shall submit to the governor,
6666 the lieutenant governor, the speaker of the house of
6767 representatives, and the appropriate standing committees of the
6868 legislature a report regarding the results of the study conducted
6969 under Subsection (b), together with any recommendations for
7070 legislation. If joint recommendations cannot be made, the
7171 department and the office shall list their recommendations
7272 separately.
7373 (d) This section expires January 1, 2013.
7474 Sec. 32.025. TEXAS PERSONAL AUTOMOBILE INSURANCE STUDY.
7575 (a) In this section, "personal automobile insurance" means motor
7676 vehicle insurance coverage for the ownership, maintenance, or use
7777 of a private passenger, utility, or miscellaneous type motor
7878 vehicle, including a motor home, mobile home, trailer, or
7979 recreational vehicle, that is:
8080 (1) owned or leased by one or more individuals; and
8181 (2) not primarily used for the delivery of goods,
8282 materials, or services, other than for use in farm or ranch
8383 operations.
8484 (b) The department and the office of public insurance
8585 counsel shall study:
8686 (1) personal automobile insurance rates in this state;
8787 (2) regulatory changes with the potential to lower
8888 personal automobile insurance rates over time in a sustainable
8989 manner;
9090 (3) practices by individual companies that have the
9191 effect of lowering personal automobile insurance rates or
9292 increasing customer satisfaction over time in a sustainable manner;
9393 (4) other states' laws that have the effect of lowering
9494 personal automobile insurance rates over time in a sustainable
9595 manner;
9696 (5) in an effort to identify practices that lower
9797 insurance rates, the similarities and differences between the
9898 personal automobile insurance market and the commercial automobile
9999 insurance market in this state;
100100 (6) industry practices and regulatory changes that
101101 encourage policyholders to learn more about the insurance market
102102 and to actively shop for insurance alternatives, and that overcome
103103 technological barriers facing certain consumers or groups of
104104 consumers;
105105 (7) industry practices and regulatory changes that
106106 encourage mid-level and small-level carriers to compete for
107107 increased market share and that attract new carriers to Texas;
108108 (8) the role of general economic factors such as
109109 inflation and changes in the costs of certain products and services
110110 in the setting of personal automobile insurance rates;
111111 (9) the effects of fraud on insurance rates and
112112 strategies to reduce fraud in this state;
113113 (10) the number of uninsured drivers in this state,
114114 the effects they have on personal automobile insurance rates, and
115115 strategies for reducing the number of uninsured drivers;
116116 (11) practices that increase efficiency and decrease
117117 administrative costs in the requests for information and data by
118118 the department and the conveyance of information and data by
119119 companies; and
120120 (12) the effect of the market cycle by which insurance
121121 costs and underwriting criteria change due to economic factors on
122122 the affordability and availability of insurance.
123123 (c) Not later than September 1, 2012, the department and the
124124 office of public insurance counsel shall submit to the governor,
125125 the lieutenant governor, the speaker of the house of
126126 representatives, and the appropriate standing committees of the
127127 legislature a report regarding the results of the study conducted
128128 under Subsection (b), together with any recommendations for
129129 legislation. If joint recommendations cannot be made, the
130130 department and the office shall list their recommendations
131131 separately.
132132 (d) This section expires January 1, 2013.
133133 SECTION 3. Section 32.103, Insurance Code, is amended to
134134 read as follows:
135135 Sec. 32.103. PUBLIC INFORMATION CONCERNING INTERNET
136136 WEBSITE. The department and the office of public insurance counsel
137137 shall publicize the existence of the Internet website required by
138138 this subchapter in a conspicuous manner on any websites,
139139 correspondence, or publications created by the department or the
140140 office, as part of the program to facilitate resolution of
141141 policyholder complaints as provided by Section 521.002.
142142 SECTION 4. Section 32.104, Insurance Code, is amended by
143143 amending Subsection (b) and adding Subsections (c) and (d) to read
144144 as follows:
145145 (b) An insurer shall provide in a conspicuous manner with
146146 each residential property insurance or personal automobile
147147 insurance policy issued in this state, and on any correspondence
148148 sent from the insurer to an insured, notice of the Internet website
149149 required by this subchapter. An insurer is not required to provide
150150 the notice on a separate document if the notice is included on the
151151 policy or correspondence. The commissioner shall determine the
152152 form and content of the notice. An insurer that transacts business
153153 electronically and provides conspicuous notice of the Internet
154154 website required by this chapter on the insurer's website is not
155155 required to comply with this subsection.
156156 (c) To the extent possible, an insurance agent who sells a
157157 residential property insurance or personal automobile insurance
158158 policy must, at the time of the initial sale, advise the customer
159159 verbally, electronically, or in writing of the Internet website
160160 maintained under this subchapter.
161161 (d) A renewal of a residential property insurance or
162162 personal automobile insurance policy must include the location of
163163 the department's Internet website prominently displayed on the
164164 declarations page of the renewal policy.
165165 SECTION 5. Section 521.052, Insurance Code, is amended to
166166 read as follows:
167167 Sec. 521.052. INFORMATION PROVIDED. (a) The department
168168 shall provide to the public through the department's toll-free
169169 telephone number only the following information:
170170 (1) information collected or maintained by the
171171 department relating to the number and disposition of complaints
172172 received against an insurer that are justified, verified as
173173 accurate, and documented as valid, expressed as a percentage of the
174174 total number of insurance policies written by the insurer and in
175175 force on December 31 of the preceding year;
176176 (2) the rating of an insurer, if any, as published by a
177177 nationally recognized rating organization;
178178 (3) the kinds of coverage available to a consumer
179179 through any insurer writing insurance in this state;
180180 (4) an insurer's admitted assets-to-liabilities
181181 ratio; and
182182 (5) other appropriate information collected and
183183 maintained by the department.
184184 (b) The department shall make the information described by
185185 Subsection (a)(1) available to the public through the department's
186186 Internet website.
187187 SECTION 6. Section 551.054, Insurance Code, is amended by
188188 adding Subsections (d) and (e) to read as follows:
189189 (d) An insurer that refuses to renew a residential property
190190 insurance policy or a personal automobile insurance policy but
191191 offers a different policy in the place of that policy shall provide
192192 to the insured:
193193 (1) a table that clearly lists the premium charged
194194 under the original policy, the premium charged under the new
195195 policy, and the percentage change, if any, between those amounts;
196196 (2) an explanation, in plain language, of any changes
197197 in the coverage under the new policy; and
198198 (3) notice of the department's Internet website that
199199 is designated by the department to help consumers compare premiums
200200 and coverages of different insurers' policies.
201201 (e) The commissioner shall adopt appropriate wording for
202202 notice under Subsection (d).
203203 SECTION 7. Subchapter B, Chapter 2301, Insurance Code, is
204204 amended by adding Sections 2301.0535, 2301.0536, and 2301.0537 to
205205 read as follows:
206206 Sec. 2301.0535. REQUIRED INFORMATION IN RENEWAL POLICY.
207207 (a) At the time a residential property insurance policy or a
208208 personal automobile insurance policy is renewed, the insurer shall
209209 provide to the insured:
210210 (1) a table that conspicuously and clearly lists the
211211 premium charged under the policy before renewal, the new premium
212212 charged under the renewal policy, and the percentage change, if
213213 any, between those amounts; and
214214 (2) notice of the department's Internet website
215215 designated by the department to help consumers compare premiums and
216216 coverages of different insurers' policies.
217217 (b) The commissioner shall adopt appropriate wording for
218218 notice under this section.
219219 Sec. 2301.0536. UPDATED POLICY REQUIRED. At any time there
220220 is a change in the coverage of a residential property insurance
221221 policy or personal automobile insurance policy, the insurer, on
222222 request from the consumer, shall provide the consumer with an
223223 updated declarations page and the policy form that was changed. The
224224 insurer shall inform the insured of the insured's right to request
225225 an updated copy of the policy that identifies the changes.
226226 Sec. 2301.0537. STATEMENT OF DEDUCTIBLE. (a) A
227227 residential property insurance policy, personal automobile
228228 insurance policy, or other document that expresses a deductible as
229229 a percentage of the coverage amount must state the actual dollar
230230 amount of the deductible next to the percentage.
231231 (b) If a residential property insurance policy or personal
232232 automobile insurance policy includes an endorsement or other
233233 provision that includes a variable deductible or a deductible with
234234 an escalator clause, the policy or document must explain how the
235235 deductible will be calculated and provide an example of how the
236236 deductible will be calculated, stating the actual dollar cost for
237237 the example.
238238 SECTION 8. Subsection (d), Section 32.104, Subsection (d),
239239 Section 551.054, and Sections 2301.0535, 2301.0536, and 2301.0537,
240240 Insurance Code, as added by this Act, apply only to an insurance
241241 policy or contract that is delivered, issued for delivery, or
242242 renewed on or after January 1, 2012. An insurance policy or
243243 contract delivered, issued for delivery, or renewed before January
244244 1, 2012, is governed by the law as it existed immediately before the
245245 effective date of this Act, and that law is continued in effect for
246246 that purpose.
247247 SECTION 9. This Act takes effect September 1, 2011.
