| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Subtitle C, Title 5, Insurance Code, is amended | |
| 13 | 13 | by adding Chapter 563 to read as follows: | |
| 14 | 14 | CHAPTER 563. PRACTICES RELATING TO CLAIMS REPORTING | |
| 15 | 15 | Sec. 563.001. DEFINITIONS. In this chapter: | |
| 16 | 16 | (1) "Claims database" means a database used by | |
| 17 | 17 | insurers to share, among insurers, insureds' claims histories or | |
| 18 | 18 | damage reports concerning covered properties. | |
| 19 | 19 | (2) "Insurer," "personal automobile insurance," and | |
| 20 | 20 | "residential property insurance" have the meanings assigned by | |
| 21 | 21 | Section 2254.001. | |
| 22 | 22 | Sec. 563.002. REPORTING TO CLAIMS DATABASE. An insurer or | |
| 23 | 23 | an insurer's agent may not report to a claims database information | |
| 24 | 24 | regarding an inquiry by an insured regarding coverage provided | |
| 25 | 25 | under a personal automobile insurance policy or a residential | |
| 26 | 26 | property insurance policy unless and until the insured files a | |
| 27 | 27 | claim under the policy. | |
| 28 | 28 | SECTION 2. This Act takes effect September 1, 2011. |
