| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 54.203, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (a-3) to read as follows: |
|---|
| 12 | 12 | | (a-3) Notwithstanding Subsection (a)(4), a person who meets |
|---|
| 13 | 13 | | the requirements of Subsection (a)(4), other than the requirement |
|---|
| 14 | 14 | | that the person must have served on active military duty for more |
|---|
| 15 | 15 | | than the stated number of days, is entitled to the exemption |
|---|
| 16 | 16 | | provided by Subsection (a)(4) regardless of the length of the |
|---|
| 17 | 17 | | member's active military duty if the person was a member of the |
|---|
| 18 | 18 | | Texas National Guard or the Texas Air National Guard who was |
|---|
| 19 | 19 | | assigned to a theater of combat operation with the armed forces of |
|---|
| 20 | 20 | | the United States. |

| 21 | 21 | | SECTION 2. Subsection (a-3), Section 54.203, Education |
|---|
| 22 | 22 | | Code, as added by this Act, applies beginning with tuition and fees |
|---|
| 23 | 23 | | at a public institution of higher education for the 2011 fall |
|---|
| 24 | 24 | | semester. Tuition and fees for a term or semester before the 2011 |
|---|
| 25 | 25 | | fall semester are covered by the law in effect immediately before |
|---|
| 26 | 26 | | the effective date of this Act, and the former law is continued in |
|---|
| 27 | 27 | | effect for that purpose. |

| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2011. |
