77 relating to tuition and fee exemptions at public institutions of
88 higher education for certain Texas military veterans.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 54.203, Education Code, is amended by
1111 adding Subsection (a-3) to read as follows:
1212 (a-3) Notwithstanding Subsection (a)(4), a person who meets
1313 the requirements of Subsection (a)(4), other than the requirement
1414 that the person must have served on active military duty for more
1515 than the stated number of days, is entitled to the exemption
1616 provided by Subsection (a)(4) regardless of the length of the
1717 member's active military duty if the person was a member of the
1818 Texas National Guard or the Texas Air National Guard who was
1919 assigned to a theater of combat operation with the armed forces of
2020 the United States.
2121 SECTION 2. Subsection (a-3), Section 54.203, Education
2222 Code, as added by this Act, applies beginning with tuition and fees
2323 at a public institution of higher education for the 2011 fall
2424 semester. Tuition and fees for a term or semester before the 2011
2525 fall semester are covered by the law in effect immediately before
2626 the effective date of this Act, and the former law is continued in
2727 effect for that purpose.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2011.
