| 13 | 13 | | communications industry through the universal service fund. |

| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Section 56.025, Utilities Code, is amended by |
|---|
| 16 | 16 | | adding Subsection (g) to read as follows: |
|---|
| 17 | 17 | | (g) Notwithstanding Subsection (a), a local exchange |
|---|
| 18 | 18 | | company that has been receiving support under a commission order |
|---|
| 19 | 19 | | issued under this section before January 1, 2005, is entitled to |
|---|
| 20 | 20 | | continue to receive that support. The commission may not require |
|---|
| 21 | 21 | | the company to reimburse the commission for support that the |
|---|
| 22 | 22 | | company received under this section on or after January 1, 2005, and |
|---|
| 23 | 23 | | before the date this subsection takes effect. |

| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2011. |
