77 relating to director elections and powers of the Texana Groundwater
88 Conservation District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 ARTICLE 1. ELECTION DATE
1111 SECTION 1.01. NOVEMBER ELECTIONS. Subsection (b), Section
1212 8, Chapter 307, Acts of the 77th Legislature, Regular Session,
1313 2001, is amended to read as follows:
1414 (b) On the uniform election date in November of each
1515 even-numbered year [first Saturday in May of each subsequent second
1616 year following the election], the appropriate number of directors
1717 shall be elected.
1818 SECTION 1.02. NOVEMBER ELECTIONS. Subsection (b), Section
1919 3.1108, Chapter 966, Acts of the 77th Legislature, Regular Session,
2020 2001, is amended to read as follows:
2121 (b) On the uniform election date in November of each
2222 even-numbered year [first Saturday in May of each subsequent second
2323 year following the election], the appropriate number of directors
2424 shall be elected.
2525 ARTICLE 2. DISTRICT POWERS
2626 SECTION 2.01. NO EMINENT DOMAIN POWER. (a) Chapter 307,
2727 Acts of the 77th Legislature, Regular Session, 2001, is amended by
2828 adding Section 4A to read as follows:
2929 Sec. 4A. NO EMINENT DOMAIN POWER. The district may not
3030 exercise the powers granted by Section 36.105, Water Code.
3131 (b) Chapter 966, Acts of the 77th Legislature, Regular
3232 Session, 2001, is amended by adding Section 3.11041 to read as
3333 follows:
3434 Sec. 3.11041. NO EMINENT DOMAIN POWER. The district may not
3535 exercise the powers granted by Section 36.105, Water Code.
3636 SECTION 2.02. CONTRACTS WITH OTHER GOVERNMENTAL ENTITIES.
3737 Subsection (b), Section 10, Chapter 307, Acts of the 77th
3838 Legislature, Regular Session, 2001, is amended to read as follows:
3939 (b) The district may contract with other governmental
4040 entities[, including river authorities located in the district,]
4141 for the performance of any or all district functions. The district
4242 may not contract with a [A] river authority to perform district
4343 functions except as provided by Chapter 791, Government Code [with
4444 which the district contracts under this section may perform
4545 district functions as provided by the contract]. The district may
4646 not exercise the powers granted by Section 36.105, Water Code.
4747 SECTION 2.03. CONTRACTS WITH OTHER GOVERNMENTAL ENTITIES.
4848 Subsection (b), Section 3.1110, Chapter 966, Acts of the 77th
4949 Legislature, Regular Session, 2001, is amended to read as follows:
5050 (b) The district may contract with other governmental
5151 entities[, including river authorities located in the district,]
5252 for the performance of any or all district functions. The district
5353 may not contract with a [A] river authority to perform district
5454 functions except as provided by Chapter 791, Government Code [with
5555 which the district contracts under this section may perform
5656 district functions as provided by the contract].
5757 ARTICLE 3. TRANSITION; VALIDATION; EFFECTIVE DATE
5858 SECTION 3.01. TRANSITION. A member of the board of
5959 directors of the Texana Groundwater Conservation District who is
6060 serving as a director on the day before the effective date of this
6161 Act shall serve until the director's term expires. A director whose
6262 term expires in May 2012 shall continue to serve until the
6363 director's successor has qualified following the directors'
6464 election held on the uniform election date in November 2012 in
6565 accordance with Section 8, Chapter 307, and Section 3.1108, Chapter
6666 966, Acts of the 77th Legislature, Regular Session, 2001, as
6767 amended by this Act. A director whose term expires in May 2014
6868 shall continue to serve until the director's successor has
6969 qualified following the directors' election held on the uniform
7070 election date in November 2014.
7171 SECTION 3.02. VALIDATION. (a) All governmental acts and
7272 proceedings of the Texana Groundwater Conservation District
7373 relating to the election or appointment of members of the board of
7474 directors of the district that were taken before the effective date
7575 of this Act are validated, ratified, and confirmed in all respects
7676 as if they had been taken as authorized by law.
7777 (b) This section does not apply to any matter that on the
7878 effective date of this Act:
7979 (1) is involved in litigation if the litigation
8080 ultimately results in the matter being held invalid by a final court
8181 judgment; or
8282 (2) has been held invalid by a final court judgment.
8383 SECTION 3.03. FINDINGS RELATED TO PROCEDURAL REQUIREMENTS.
8484 (a) The legal notice of the intention to introduce this Act,
8585 setting forth the general substance of this Act, has been published
8686 as provided by law, and the notice and a copy of this Act have been
8787 furnished to all persons, agencies, officials, or entities to which
8888 they are required to be furnished under Section 59, Article XVI,
8989 Texas Constitution, and Chapter 313, Government Code.
9090 (b) The governor, one of the required recipients, has
9191 submitted the notice and Act to the Texas Commission on
9292 Environmental Quality.
9393 (c) The Texas Commission on Environmental Quality has filed
9494 its recommendations relating to this Act with the governor, the
9595 lieutenant governor, and the speaker of the house of
9696 representatives within the required time.
9797 (d) All requirements of the constitution and laws of this
9898 state and the rules and procedures of the legislature with respect
9999 to the notice, introduction, and passage of this Act are fulfilled
100100 and accomplished.
101101 SECTION 3.04. EFFECTIVE DATE. This Act takes effect
102102 immediately if it receives a vote of two-thirds of all the members
103103 elected to each house, as provided by Section 39, Article III, Texas
104104 Constitution. If this Act does not receive the vote necessary for
105105 immediate effect, this Act takes effect September 1, 2011.
