| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 43.033, Local Government Code, is |
|---|
| 15 | 15 | | amended by adding Subsection (c) to read as follows: |
|---|
| 16 | 16 | | (c) Subsection (a)(3) does not apply to a municipality that |
|---|
| 17 | 17 | | annexes an area that receives water and sewer service from a |
|---|
| 18 | 18 | | municipal utility district that provides water and sewer service to |
|---|
| 19 | 19 | | all or part of the municipality. |

| 20 | 20 | | SECTION 2. Section 43.033, Local Government Code, as |
|---|
| 21 | 21 | | amended by this Act, applies only to an annexation of an area for |
|---|
| 22 | 22 | | which a municipality institutes proceedings to annex the area on or |
|---|
| 23 | 23 | | after the effective date of this Act. The annexation of an area for |
|---|
| 24 | 24 | | which a municipality institutes annexation proceedings before that |
|---|
| 25 | 25 | | date is governed by the law in effect immediately before the |
|---|
| 26 | 26 | | effective date of this Act, and the former law is continued in |
|---|
| 27 | 27 | | effect for that purpose. |

| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2011. |
