77 relating to examination requirements for certain applicants for a
88 license to practice medicine.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 155.051, Occupations Code, is amended by
1111 adding Subsections (d) and (e) to read as follows:
1212 (d) The time frame to pass each part of the examination does
1313 not apply to an applicant who:
1414 (1) is licensed and in good standing as a physician in
1515 another state;
1616 (2) has been licensed for at least five years;
1717 (3) does not hold a medical license in the other state
1818 that has or has ever had any restrictions, disciplinary orders, or
1919 probation; and
2020 (4) will practice in a medically underserved area or a
2121 health manpower shortage area, as those terms are defined by
2222 Section 157.052.
2323 (e) The board may by rule establish a process to verify that
2424 a person, after meeting the requirements of Subsection (d),
2525 practices only in an area described by Subsection (d)(4).
2626 SECTION 2. Section 155.056, Occupations Code, is amended by
2727 adding Subsections (e) and (f) to read as follows:
2828 (e) The limitation on examination attempts by an applicant
2929 under Subsection (a) does not apply to an applicant who:
3030 (1) is licensed and in good standing as a physician in
3131 another state;
3232 (2) has been licensed for at least five years;
3333 (3) does not hold a medical license in the other state
3434 that has or has ever had any restrictions, disciplinary orders, or
3535 probation; and
3636 (4) will practice in a medically underserved area or a
3737 health manpower shortage area, as those terms are defined by
3838 Section 157.052.
3939 (f) The board may by rule establish a process to verify that
4040 a person who, after meeting the requirements of Subsection (e),
4141 practices only in an area described by Subsection (e)(4).
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2011.
