| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Subsection (r), Section 28.002, Education Code, |
|---|
| 16 | 16 | | is amended to read as follows: |
|---|
| 17 | 17 | | (r) The [In adopting the essential knowledge and skills for |
|---|
| 18 | 18 | | the health curriculum under Subsection (a)(2)(B), the] State Board |
|---|
| 19 | 19 | | of Education by rule shall require a school district or |
|---|
| 20 | 20 | | open-enrollment charter school to provide instruction [adopt |
|---|
| 21 | 21 | | essential knowledge and skills] that addresses [address] the |
|---|
| 22 | 22 | | dangers, causes, consequences, signs, symptoms, and treatment of |
|---|
| 23 | 23 | | binge drinking and alcohol poisoning to students in middle school, |
|---|
| 24 | 24 | | junior high school, and high school. The agency shall compile a |
|---|
| 25 | 25 | | list of evidence-based alcohol awareness programs from which a |
|---|
| 26 | 26 | | school district or open-enrollment charter school shall choose a |
|---|
| 27 | 27 | | program to use in the district's or school's middle school, junior |
|---|
| 28 | 28 | | high school, and high school science [health] curriculum. A high |
|---|
| 29 | 29 | | school shall use a program chosen under this subsection in a course |
|---|
| 30 | 30 | | that satisfies the science curriculum requirement for graduation |
|---|
| 31 | 31 | | under Section 28.025(b-1)(1)(A). In this subsection, |
|---|
| 32 | 32 | | "evidence-based alcohol awareness program" means a program, |
|---|
| 33 | 33 | | practice, or strategy that has been proven to effectively prevent |
|---|
| 34 | 34 | | or delay alcohol use among students, as determined by evaluations |
|---|
| 35 | 35 | | that use valid and reliable measures and that are published in |
|---|
| 36 | 36 | | peer-reviewed journals. |
|---|
| 37 | 37 | | SECTION 2. This Act applies beginning with the 2011-2012 |
|---|
| 38 | 38 | | school year. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2011. |
