1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to an alcohol awareness component of the science
1313 curriculum used in public schools.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subsection (r), Section 28.002, Education Code,
1616 is amended to read as follows:
1717 (r) The [In adopting the essential knowledge and skills for
1818 the health curriculum under Subsection (a)(2)(B), the] State Board
1919 of Education by rule shall require a school district or
2020 open-enrollment charter school to provide instruction [adopt
2121 essential knowledge and skills] that addresses [address] the
2222 dangers, causes, consequences, signs, symptoms, and treatment of
2323 binge drinking and alcohol poisoning to students in middle school,
2424 junior high school, and high school. The agency shall compile a
2525 list of evidence-based alcohol awareness programs from which a
2626 school district or open-enrollment charter school shall choose a
2727 program to use in the district's or school's middle school, junior
2828 high school, and high school science [health] curriculum. A high
2929 school shall use a program chosen under this subsection in a course
3030 that satisfies the science curriculum requirement for graduation
3131 under Section 28.025(b-1)(1)(A). In this subsection,
3232 "evidence-based alcohol awareness program" means a program,
3333 practice, or strategy that has been proven to effectively prevent
3434 or delay alcohol use among students, as determined by evaluations
3535 that use valid and reliable measures and that are published in
3636 peer-reviewed journals.
3737 SECTION 2. This Act applies beginning with the 2011-2012
3838 school year.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2011.
