66 AN ACT
77 relating to changes in the single-member district boundaries of the
88 Barton Springs-Edwards Aquifer Conservation District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 8802.053, Special District Local Laws
1111 Code, is amended by amending Subsection (c) and adding Subsection
1212 (c-1) to read as follows:
1313 (c) As soon as practicable after the publication of each
1414 federal decennial census, the board shall revise the single-member
1515 districts as the board considers appropriate to reflect population
1616 changes.
1717 (c-1) In this subsection, a reference to a highway, street,
1818 road, avenue, boulevard, or lane means the centerline of that
1919 highway, street, road, avenue, boulevard, or lane. When the board
2020 revises the single-member districts [under this subsection], the
2121 board shall place two of the districts wholly within the territory
2222 described as follows: Beginning at the eastern district boundary
2323 and the Colorado River, then south along the eastern district
2424 boundary to the intersection of Interstate Highway 35 and Slaughter
2525 Lane; then west along Slaughter Lane to the district boundary, then
2626 north along the district boundary to the Colorado River, then east
2727 along the Colorado River following the district boundary to the
2828 point of the beginning
2929 [(1) entirely within the boundaries of the city of
3030 Austin, as those boundaries exist at that time; or
3131 [(2) within the boundaries of the city of Austin, as
3232 those boundaries exist at that time, but also including
3333 unincorporated areas or other municipalities that are surrounded
3434 wholly or partly by the boundaries of the city of Austin if the
3535 areas or municipalities are noncontiguous to the territory of any
3636 other single-member district].
3737 SECTION 2. Subchapter B, Chapter 8802, Special District
3838 Local Laws Code, is amended by adding Section 8802.054 to read as
3939 follows:
4040 Sec. 8802.054. APPLICABILITY OF OTHER LAW. Section
4141 36.059(b), Water Code, does not apply to the district.
4242 SECTION 3. Subsection (b), Section 8802.051, and Subsection
4343 (d), Section 8802.053, Special District Local Laws Code, are
4444 repealed.
4545 SECTION 4. (a) The legal notice of the intention to
4646 introduce this Act, setting forth the general substance of this
4747 Act, has been published as provided by law, and the notice and a
4848 copy of this Act have been furnished to all persons, agencies,
4949 officials, or entities to which they are required to be furnished
5050 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5151 Government Code.
5252 (b) The governor has submitted the notice and Act to the
5353 Texas Commission on Environmental Quality.
5454 (c) The Texas Commission on Environmental Quality has filed
5555 its recommendations relating to this Act with the governor,
5656 lieutenant governor, and speaker of the house of representatives
5757 within the required time.
5858 (d) All requirements of the constitution and laws of this
5959 state and the rules and procedures of the legislature with respect
6060 to the notice, introduction, and passage of this Act are fulfilled
6161 and accomplished.
6262 SECTION 5. This Act takes effect September 1, 2011.
