77 AN ACT
88 relating to including certain veterans service organizations as
99 small businesses for the purpose of state contracting.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subsection (a), Section 2155.505, Government
1212 Code, is amended by amending Subdivision (2) and adding Subdivision
1313 (3) to read as follows:
1414 (2) "Small business" means a small business concern as
1515 defined by regulations of the United States Small Business
1616 Administration in 13 C.F.R. Section 121.201 or a veterans service
1717 agency.
1818 (3) "Veterans service agency" means a community-based
1919 organization that:
2020 (A) is exempt from taxation under Section 501(a),
2121 Internal Revenue Code of 1986, as an organization described in
2222 Section 501(c)(3) of that code;
2323 (B) has as its principal purpose to provide
2424 housing, substance abuse treatment, case management services, and
2525 employment training to low-income veterans, disabled veterans, and
2626 homeless veterans and their families; and
2727 (C) employs veterans to provide at least 75
2828 percent of the hours of direct labor by individuals required to
2929 produce goods or provide services required under a contract entered
3030 into under this section.
3131 SECTION 2. Subsection (a), Section 2155.505, Government
3232 Code, as amended by this Act, applies only to a contract for the
3333 procurement of goods and services for which the solicitation of
3434 bids or proposals, request for proposals, or similar required
3535 notification as to the goods or services is published on or after
3636 September 1, 2011. A contract for the procurement of goods and
3737 services for which the solicitation of bids or proposals, request
3838 for proposals, or similar required notification as to the goods or
3939 services is published before September 1, 2011, is governed by the
4040 law in effect at the time the solicitation, request, or
4141 notification is published, and that law is continued in effect for
4242 that purpose.
4343 SECTION 3. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2011.
