1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to power of the Texas Commission on Environmental Quality
1313 to authorize certain injection wells that transect or terminate in
1414 the Edwards Aquifer.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subchapter D, Chapter 27, Water Code, is amended
1717 by adding Sections 27.0516 and 27.0517 to read as follows:
1818 Sec. 27.0516. PERMITS FOR INJECTION WELLS THAT TRANSECT OR
1919 TERMINATE IN PORTION OF EDWARDS AQUIFER OUTSIDE BOUNDARIES OF
2020 EDWARDS AQUIFER AUTHORITY. (a) In this section:
2121 (1) "Edwards Aquifer" has the meaning assigned by
2222 Section 26.046(a).
2323 (2) "Fresh water" means water that contains a total
2424 dissolved solids concentration of not more than 1,000 milligrams
2525 per liter and is otherwise suitable as a source of drinking water
2626 supply.
2727 (3) "Saline portion of the Edwards Aquifer" means the
2828 portion of the Edwards Aquifer that contains only groundwater with
2929 a total dissolved solids concentration of more than 1,000
3030 milligrams per liter.
3131 (b) This section applies only to the portion of the Edwards
3232 Aquifer that is outside the boundaries of the Edwards Aquifer
3333 Authority.
3434 (c) Except as otherwise provided by this section, the
3535 commission by rule or permit may not authorize an injection well
3636 that transects or terminates in the Edwards Aquifer.
3737 (d) The commission by rule or permit may authorize:
3838 (1) an injection well for the purpose of injecting
3939 into the saline portion of the Edwards Aquifer:
4040 (A) concentrate from a desalination facility;
4141 and
4242 (B) fresh water as part of a designed aquifer
4343 storage and recovery facility;
4444 (2) the injection of the following in a well that
4545 transects or terminates in the Edwards Aquifer for the purpose of
4646 providing additional recharge:
4747 (A) groundwater withdrawn from the Edwards
4848 Aquifer; and
4949 (B) captured storm water runoff, water captured
5050 in a rainwater harvesting system, or groundwater withdrawn from an
5151 aquifer other than the Edwards Aquifer, if provision is made for
5252 protecting and maintaining the quality of water in the receiving
5353 portion of the Edwards Aquifer;
5454 (3) the injection of storm water or flood water into
5555 the Edwards Aquifer by means of a natural recharge feature such as a
5656 sinkhole or cave located in a karst topographic area for the purpose
5757 of providing additional recharge; and
5858 (4) an injection well that transects or terminates in
5959 the Edwards Aquifer for:
6060 (A) aquifer remediation;
6161 (B) the injection of a nontoxic tracer dye as
6262 part of a hydrologic study; or
6363 (C) another beneficial purpose that will protect
6464 an underground source of drinking water from pollution.
6565 Sec. 27.0517. PERMITS FOR INJECTION WELLS THAT TRANSECT OR
6666 TERMINATE IN PORTION OF EDWARDS AQUIFER INSIDE BOUNDARIES OF
6767 EDWARDS AQUIFER AUTHORITY. (a) In this section, "Edwards Aquifer"
6868 has the meaning assigned by Section 26.046(a).
6969 (b) This section applies only to the portion of the Edwards
7070 Aquifer that is inside the boundaries of the Edwards Aquifer
7171 Authority.
7272 (c) Except as otherwise provided by this section, the
7373 commission by rule or permit may not authorize an injection well
7474 that transects or terminates in the Edwards Aquifer.
7575 (d) The commission by rule or permit may authorize:
7676 (1) the injection of the following in a well that
7777 transects or terminates in the Edwards Aquifer for the purpose of
7878 providing additional recharge:
7979 (A) groundwater withdrawn from the Edwards
8080 Aquifer; and
8181 (B) storm water, flood water, or groundwater from
8282 an aquifer other than the Edwards Aquifer, if provision is made for
8383 protecting and maintaining the quality of groundwater in the
8484 receiving portion of the Edwards Aquifer;
8585 (2) the injection of storm water, flood water, or
8686 groundwater from an aquifer other than the Edwards Aquifer by means
8787 of a natural recharge feature such as a sinkhole or cave located in
8888 a karst topographic area for the purpose of providing additional
8989 recharge; and
9090 (3) an injection well that transects or terminates in
9191 the Edwards Aquifer for:
9292 (A) aquifer remediation;
9393 (B) the injection of a nontoxic tracer dye as
9494 part of a hydrologic study; or
9595 (C) another beneficial purpose that will protect
9696 an underground source of drinking water from pollution.
9797 SECTION 2. Subsection (e), Section 1.44, Chapter 626, Acts
9898 of the 73rd Legislature, Regular Session, 1993, is amended to read
9999 as follows:
100100 (e) The authority may contract for injection or other
101101 artificial recharge under this section only if:
102102 (1) provision is made for protecting and maintaining
103103 the quality of groundwater in the receiving part of the aquifer;
104104 (2) [, and:
105105 [(1)] the water used [for artificial recharge] is:
106106 (A) groundwater withdrawn from the aquifer; or
107107 (B) storm water, flood water, or groundwater from
108108 an aquifer other than the aquifer; and
109109 (3) [(2)] the water is recharged:
110110 (A) through:
111111 (i) a natural recharge feature such as a
112112 sinkhole or cave located in a karst topographic area; or
113113 (ii) an injection well; or
114114 (B) by infiltration.
115115 SECTION 3. Subsection (h), Section 27.051, Water Code, as
116116 added by Chapter 966 (S.B. 2), Acts of the 77th Legislature, Regular
117117 Session, 2001, is repealed.
118118 SECTION 4. This Act takes effect September 1, 2011.
