99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1111 Code, is amended by adding Chapter 8354 to read as follows:
1212 CHAPTER 8354. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 524
1313 SUBCHAPTER A. GENERAL PROVISIONS
1414 Sec. 8354.001. DEFINITIONS. In this chapter:
1515 (1) "Board" means the district's board of directors.
1616 (2) "Commission" means the Texas Commission on
1717 Environmental Quality.
1818 (3) "Director" means a board member.
1919 (4) "District" means the Harris County Municipal
2020 Utility District No. 524.
2121 Sec. 8354.002. NATURE OF DISTRICT. The district is a
2222 municipal utility district created under Section 59, Article XVI,
2323 Texas Constitution.
2424 Sec. 8354.003. CONFIRMATION AND DIRECTORS' ELECTION
2525 REQUIRED. The temporary directors shall hold an election to
2626 confirm the creation of the district and to elect five permanent
2727 directors as provided by Section 49.102, Water Code.
2828 Sec. 8354.004. CONSENT OF MUNICIPALITY REQUIRED. The
2929 temporary directors may not hold an election under Section 8354.003
3030 until each municipality in whose corporate limits or
3131 extraterritorial jurisdiction the district is located has
3232 consented by ordinance or resolution to the creation of the
3333 district and to the inclusion of land in the district.
3434 Sec. 8354.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3535 (a) The district is created to serve a public purpose and benefit.
3636 (b) The district is created to accomplish the purposes of:
3737 (1) a municipal utility district as provided by
3838 general law and Section 59, Article XVI, Texas Constitution; and
3939 (2) Section 52, Article III, Texas Constitution, that
4040 relate to the construction, acquisition, or improvement of
4141 macadamized, graveled, or paved roads described by Section 54.234,
4242 Water Code, or improvements, including storm drainage, in aid of
4343 those roads.
4444 Sec. 8354.006. INITIAL DISTRICT TERRITORY. (a) The
4545 district is initially composed of the territory described by
4646 Section 2 of the Act enacting this chapter.
4747 (b) The boundaries and field notes contained in Section 2 of
4848 the Act enacting this chapter form a closure. A mistake made in the
4949 field notes or in copying the field notes in the legislative process
5050 does not affect the district's:
5151 (1) organization, existence, or validity;
5252 (2) right to issue any type of bond for the purposes
5353 for which the district is created or to pay the principal of and
5454 interest on a bond;
5555 (3) right to impose a tax; or
5656 (4) legality or operation.

5858 SUBCHAPTER B. BOARD OF DIRECTORS
5959 Sec. 8354.051. GOVERNING BODY; TERMS. (a) The district is
6060 governed by a board of five elected directors.
6161 (b) Except as provided by Section 8354.052, directors serve
6262 staggered four-year terms.
6363 Sec. 8354.052. TEMPORARY DIRECTORS. (a) On or after the
6464 effective date of the Act enacting this chapter, the owner or owners
6565 of a majority of the assessed value of the real property in the
6666 district may submit a petition to the commission requesting that
6767 the commission appoint as temporary directors the five persons
6868 named in the petition. The commission shall appoint as temporary
6969 directors the five persons named in the petition.
7070 (b) Temporary directors serve until the earlier of:
7171 (1) the date permanent directors are elected under
7272 Section 8354.003; or
7373 (2) the fourth anniversary of the effective date of
7474 the Act enacting this chapter.
7575 (c) If permanent directors have not been elected under
7676 Section 8354.003 and the terms of the temporary directors have
7777 expired, successor temporary directors shall be appointed or
7878 reappointed as provided by Subsection (d) to serve terms that
7979 expire on the earlier of:
8080 (1) the date permanent directors are elected under
8181 Section 8354.003; or
8282 (2) the fourth anniversary of the date of the
8383 appointment or reappointment.
8484 (d) If Subsection (c) applies, the owner or owners of a
8585 majority of the assessed value of the real property in the district
8686 may submit a petition to the commission requesting that the
8787 commission appoint as successor temporary directors the five
8888 persons named in the petition. The commission shall appoint as
8989 successor temporary directors the five persons named in the
9090 petition.

9292 SUBCHAPTER C. POWERS AND DUTIES
9393 Sec. 8354.101. GENERAL POWERS AND DUTIES. The district has
9494 the powers and duties necessary to accomplish the purposes for
9595 which the district is created.
9696 Sec. 8354.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9797 DUTIES. The district has the powers and duties provided by the
9898 general law of this state, including Chapters 49 and 54, Water Code,
9999 applicable to municipal utility districts created under Section 59,
100100 Article XVI, Texas Constitution.
101101 Sec. 8354.103. AUTHORITY FOR ROAD PROJECTS. (a) Under
102102 Section 52, Article III, Texas Constitution, the district may
103103 design, acquire, construct, finance, issue bonds for, improve, and
104104 convey to this state, a county, or a municipality for operation and
105105 maintenance macadamized, graveled, or paved roads described by
106106 Section 54.234, Water Code, or improvements, including storm
107107 drainage, in aid of those roads.
108108 (b) The district may exercise the powers provided by this
109109 section without submitting a petition to or obtaining approval from
110110 the commission as required by Section 54.234, Water Code.
111111 Sec. 8354.104. APPROVAL OF ROAD PROJECT. (a) The district
112112 may not undertake a road project authorized by Section 8354.103
113113 unless:
114114 (1) each municipality or county that will operate and
115115 maintain the road has approved the plans and specifications of the
116116 road project, if a municipality or county will operate and maintain
117117 the road; or
118118 (2) the Texas Transportation Commission has approved
119119 the plans and specifications of the road project, if the state will
120120 operate and maintain the road.
121121 (b) Except as provided by Subsection (a), the district is
122122 not required to obtain approval from the Texas Transportation
123123 Commission to design, acquire, construct, finance, issue bonds for,
124124 improve, or convey a road project.
125125 Sec. 8354.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
126126 OR RESOLUTION. The district shall comply with all applicable
127127 requirements of any ordinance or resolution that is adopted under
128128 Section 54.016 or 54.0165, Water Code, and that consents to the
129129 creation of the district or to the inclusion of land in the
130130 district.
131131 Sec. 8354.106. LIMITATION ON USE OF EMINENT DOMAIN. The
132132 district may not exercise the power of eminent domain outside the
133133 district to acquire a site or easement for:
134134 (1) a road project authorized by Section 8354.103; or
135135 (2) a recreational facility as defined by Section
136136 49.462, Water Code.

138138 SUBCHAPTER D. DIVISION OF DISTRICT INTO MULTIPLE DISTRICTS
139139 Sec. 8354.151. DIVISION OF DISTRICT; PREREQUISITES. The
140140 district may be divided into two or more new districts only if the
141141 district:
142142 (1) has no outstanding bonded debt; and
143143 (2) is not imposing ad valorem taxes.
144144 Sec. 8354.152. LAW APPLICABLE TO NEW DISTRICT. This
145145 chapter applies to any new district created by division of the
146146 district, and a new district has all the powers and duties of the
147147 district.
148148 Sec. 8354.153. LIMITATION ON AREA OF NEW DISTRICT. A new
149149 district created by the division of the district may not, at the
150150 time the new district is created, contain any land outside the area
151151 described by Section 2 of the Act enacting this chapter.
152152 Sec. 8354.154. DIVISION PROCEDURES. (a) The board, on its
153153 own motion or on receipt of a petition signed by the owner or owners
154154 of a majority of the assessed value of the real property in the
155155 district, may adopt an order dividing the district.
156156 (b) The board may adopt an order dividing the district
157157 before or after the date the board holds an election under Section
158158 8354.003 to confirm the district's creation.
159159 (c) An order dividing the district:
160160 (1) must:
161161 (A) name each new district;
162162 (B) include the metes and bounds description of
163163 the territory of each new district;
164164 (C) appoint temporary directors for each new
165165 district, or provide that temporary directors are appointed in the
166166 manner provided by Section 8354.052(a); and
167167 (D) provide for the division of assets and
168168 liabilities between the new districts; and
169169 (2) is subject to a confirmation election in each new
170170 district.
171171 (d) On or before the 30th day after the date of adoption of
172172 an order dividing the district, the district shall file the order
173173 with the commission and record the order in the real property
174174 records of each county in which the district is located.
175175 Sec. 8354.155. CONFIRMATION ELECTION FOR NEW DISTRICT.
176176 (a) A new district created by the division of the district shall
177177 hold a confirmation and directors' election as required by Section
178178 8354.003.
179179 (b) The results of that election must be filed as required
180180 by Sections 49.102(e) and (f), Water Code.
181181 (c) If the voters of a new district do not confirm the
182182 creation of the new district, the assets, liabilities, territory,
183183 and governance of the new districts revert to the original
184184 district.
185185 Sec. 8354.156. MUNICIPAL CONSENT. Municipal consent to the
186186 creation of the district and to the inclusion of land in the
187187 district granted under Section 8354.004 acts as municipal consent
188188 to the creation of any new district created by the division of the
189189 district and to the inclusion of land in the new district.
190190 Sec. 8354.157. TAX OR BOND ELECTION. Before a new district
191191 created by the division of the district may impose a maintenance tax
192192 or issue bonds payable wholly or partly from ad valorem taxes, the
193193 new district must hold an election as required by this chapter to
194194 obtain voter approval.

196196 SUBCHAPTER E. GENERAL FINANCIAL PROVISIONS
197197 Sec. 8354.201. ELECTIONS REGARDING TAXES OR BONDS.
198198 (a) The district may issue, without an election, bonds and other
199199 obligations secured by:
200200 (1) revenue other than ad valorem taxes; or
201201 (2) contract payments described by Section 8354.203.
202202 (b) The district must hold an election in the manner
203203 provided by Chapters 49 and 54, Water Code, to obtain voter approval
204204 before the district may impose an ad valorem tax or issue bonds
205205 payable from ad valorem taxes.
206206 (c) The district may not issue bonds payable from ad valorem
207207 taxes to finance a road project unless the issuance is approved by a
208208 vote of a two-thirds majority of the district voters voting at an
209209 election held for that purpose.
210210 Sec. 8354.202. OPERATION AND MAINTENANCE TAX. (a) If
211211 authorized at an election held under Section 8354.201, the district
212212 may impose an operation and maintenance tax on taxable property in
213213 the district in accordance with Section 49.107, Water Code.
214214 (b) The board shall determine the tax rate. The rate may not
215215 exceed the rate approved at the election.
216216 Sec. 8354.203. CONTRACT TAXES. (a) In accordance with
217217 Section 49.108, Water Code, the district may impose a tax other than
218218 an operation and maintenance tax and use the revenue derived from
219219 the tax to make payments under a contract after the provisions of
220220 the contract have been approved by a majority of the district voters
221221 voting at an election held for that purpose.
222222 (b) A contract approved by the district voters may contain a
223223 provision stating that the contract may be modified or amended by
224224 the board without further voter approval.

226226 SUBCHAPTER F. BONDS AND OTHER OBLIGATIONS
227227 Sec. 8354.251. AUTHORITY TO ISSUE BONDS AND OTHER
228228 OBLIGATIONS. The district may issue bonds or other obligations
229229 payable wholly or partly from ad valorem taxes, impact fees,
230230 revenue, contract payments, grants, or other district money, or any
231231 combination of those sources, to pay for any authorized district
232232 purpose.
233233 Sec. 8354.252. TAXES FOR BONDS. At the time the district
234234 issues bonds payable wholly or partly from ad valorem taxes, the
235235 board shall provide for the annual imposition of a continuing
236236 direct ad valorem tax, without limit as to rate or amount, while all
237237 or part of the bonds are outstanding as required and in the manner
238238 provided by Sections 54.601 and 54.602, Water Code.
239239 Sec. 8354.253. BONDS FOR ROAD PROJECTS. At the time of
240240 issuance, the total principal amount of bonds or other obligations
241241 issued or incurred to finance road projects and payable from ad
242242 valorem taxes may not exceed one-fourth of the assessed value of the
243243 real property in the district.
244244 SECTION 2. The Harris County Municipal Utility District No.
245245 524 initially includes all the territory contained in the following
246246 area: 990.804 acres in 5 non-contiguous tracts out of Sections 9,
247247 10, 15, and 16 of Harris County School Land Survey, Abstract No 332,
248248 recorded in Vol 17, Pg 222 of the Deed Records of Harris County,
249249 Texas and including within Tracts 1, 2, 3, and 4 an unnamed 66 foot
250250 roadway as shown on the plat of said Harris County School Land being
251251 granted by Commissioners Award recorded in Vol 7448, Pg 181, HCDR;
252252 said roadway does not exist physically on the ground: (All bearings
253253 used herein are based on Highway Right-of-Way Maps provided by the
254254 Texas Department of Transportation)
255255 Tract 1
256256 A tract or parcel of land containing 255.572 acres (11,132,730
257257 square feet) out of Lots 9, 10, 15, and 16 of Section 9 and Lots 1,
258258 2, 7, & 8 of Section 16 of said Harris County School Land Survey,
259259 Abstract No 332, Harris County, Texas; said 255.572 acres being
260260 that same tract of land called 257.230 acres described by deed
261261 recorded in HCCF No M577056 ("Tract 1", therein) and conveyed to
262262 Delta Troy Interests, Ltd by deed recorded in X381657 and more
263263 particularly described by metes and bounds as follows:
264264 COMMENCING at a State Department of Highways and Public
265265 Transportation Horizontal Control Monument located in the
266266 southerly right-of-way line of U.S. 290, 160.00 feet at right
267267 angles from the centerline, across from Engineers Station
268268 109+27.74;
269269 THENCE along said southerly right-of-way line, clockwise,
270270 following the arc of a 1855.86 foot radius curve-to-the-right,
271271 subtending a central angle of 03 degrees 20 min 18 seconds, through
272272 an arc length of 108.13 feet (chord bearing of South 66 degrees 23
273273 minutes 38 seconds East, 108.12 feet) to a 5/8 inch iron rod found
274274 marking the POINT OF BEGINNING and most northerly Northeast corner

689689 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
690690 Government Code.
691691 (b) The governor, one of the required recipients, has
692692 submitted the notice and Act to the Texas Commission on
693693 Environmental Quality.
694694 (c) The Texas Commission on Environmental Quality has filed
695695 its recommendations relating to this Act with the governor, the
696696 lieutenant governor, and the speaker of the house of
697697 representatives within the required time.
698698 (d) All requirements of the constitution and laws of this
699699 state and the rules and procedures of the legislature with respect
700700 to the notice, introduction, and passage of this Act are fulfilled
701701 and accomplished.
702702 SECTION 4. (a) Section 8354.106, Special District Local
703703 Laws Code, as added by Section 1 of this Act, takes effect only if
704704 this Act receives a two-thirds vote of all the members elected to
705705 each house.
706706 (b) If this Act does not receive a two-thirds vote of all the
707707 members elected to each house, Subchapter C, Chapter 8354, Special
708708 District Local Laws Code, as added by Section 1 of this Act, is
709709 amended by adding Section 8354.106 to read as follows:
710710 Sec. 8354.106. NO EMINENT DOMAIN POWER. The district may
711711 not exercise the power of eminent domain.
712712 (c) This section is not intended to be an expression of a
713713 legislative interpretation of the requirements of Subsection (c),
714714 Section 17, Article I, Texas Constitution.
715715 SECTION 5. Except as provided by Section 4 of this Act:
716716 (1) this Act takes effect immediately if it receives a
717717 vote of two-thirds of all the members elected to each house, as
718718 provided by Section 39, Article III, Texas Constitution; and
719719 (2) if this Act does not receive the vote necessary for
720720 immediate effect, this Act takes effect September 1, 2011.
