9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 42.021, Local Government Code, is | |
11 | 11 | amended by amending Subsection (b) and adding Subsection (c) to | |
12 | 12 | read as follows: | |
13 | 13 | (b) Regardless of Subsection (a), the extraterritorial | |
14 | 14 | jurisdiction of a municipality is the unincorporated area that is | |
15 | 15 | contiguous to the corporate boundaries of the municipality and that | |
16 | 16 | is located: | |
17 | 17 | (1) within five miles of those boundaries on a [the] | |
18 | 18 | barrier island; or | |
19 | 19 | (2) within one-half mile of those boundaries off a | |
20 | 20 | barrier island. | |
21 | 21 | (c) Subsection (b) applies to a [if the] municipality that | |
22 | 22 | has: | |
23 | 23 | (1) a population of 2,000 or more; and | |
24 | 24 | (2) territory located: | |
25 | 25 | (A) entirely on a barrier island in the Gulf of | |
26 | 26 | Mexico; and | |
27 | 27 | (B) within 30 miles of an international border. | |
28 | 28 | SECTION 2. This Act takes effect immediately if it receives | |
29 | 29 | a vote of two-thirds of all the members elected to each house, as | |
30 | 30 | provided by Section 39, Article III, Texas Constitution. If this | |
31 | 31 | Act does not receive the vote necessary for immediate effect, this | |
32 | 32 | Act takes effect September 1, 2011. |
