By: Lucio S.B. No. 508 (Lozano, Oliveira) A BILL TO BE ENTITLED AN ACT relating to the extent of extraterritorial jurisdiction of certain less populous municipalities located on a barrier island. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 42.021, Local Government Code, is amended by amending Subsection (b) and adding Subsection (c) to read as follows: (b) Regardless of Subsection (a), the extraterritorial jurisdiction of a municipality is the unincorporated area that is contiguous to the corporate boundaries of the municipality and that is located: (1) within five miles of those boundaries on a [the] barrier island; or (2) within one-half mile of those boundaries off a barrier island. (c) Subsection (b) applies to a [if the] municipality that has: (1) a population of 2,000 or more; and (2) territory located: (A) entirely on a barrier island in the Gulf of Mexico; and (B) within 30 miles of an international border. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2011.
