1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to the regulation of LP-gas utility companies.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subsection (b), Section 101.002, Utilities Code,
1515 is amended to read as follows:
1616 (b) Gas utilities, including LP-gas utilities, are by
1717 definition monopolies in the areas they serve. As a result, the
1818 normal forces of competition that regulate prices in a free
1919 enterprise society do not operate. Public agencies regulate
2020 utility rates, operations, and services as a substitute for
2121 competition.
2222 SECTION 2. Section 101.003, Utilities Code, is amended by
2323 amending Subdivision (7) and adding Subdivision (7-a) to read as
2424 follows:
2525 (7) "Gas utility" includes a person or river authority
2626 that owns or operates for compensation in this state equipment or
2727 facilities to transmit or distribute combustible hydrocarbon
2828 natural gas or synthetic natural gas for sale or resale in a manner
2929 not subject to the jurisdiction of the Federal Energy Regulatory
3030 Commission under the Natural Gas Act (15 U.S.C. Section 717 et
3131 seq.). The term includes a lessee, trustee, or receiver of a gas
3232 utility. The term includes an LP-gas utility. The term does not
3333 include:
3434 (A) a municipal corporation;
3535 (B) a person or river authority to the extent the
3636 person or river authority:
3737 (i) produces, gathers, transports, or sells
3838 natural gas or synthetic natural gas under Section 121.004 or
3939 121.005;
4040 (ii) transports, delivers, stores,
4141 distributes, or sells liquefied petroleum gas, unless the person or
4242 river authority is an LP-gas utility as defined by this section; or
4343 (iii) transports, delivers, or sells
4444 natural gas or LP-gas for fuel for irrigation wells or any other
4545 direct agricultural use;
4646 (C) a person to the extent the person:
4747 (i) sells natural gas or LP-gas for use as
4848 vehicle fuel;
4949 (ii) sells natural gas or LP-gas to a person
5050 who later sells the natural gas or LP-gas for use as vehicle fuel;
5151 or
5252 (iii) owns or operates equipment or
5353 facilities to sell or transport natural gas or LP-gas for ultimate
5454 use as vehicle fuel;
5555 (D) a person not otherwise a gas utility who
5656 furnishes gas or gas service only to itself, its employees, or its
5757 tenants as an incident of employment or tenancy, if the gas or gas
5858 service is not resold to or used by others; or
5959 (E) a person excluded from being considered a gas
6060 utility under Section 121.007.
6161 (7-a) "LP-gas utility" means a person that owns or
6262 operates for compensation in this state equipment or facilities
6363 consisting of a contiguous, interconnected distribution piping
6464 system composed of pipe mains or service lines joined to one or more
6565 storage containers supplying liquefied petroleum gas to 10 or more
6666 residential end users who do not own or operate the distribution
6767 piping system and who are contractually obligated to use the person
6868 owning or operating the distribution piping system as the sole
6969 source provider of liquefied petroleum gas. The term includes a
7070 lessee, trustee, or receiver of an LP-gas utility. The term does
7171 not include a person not otherwise an LP-gas utility that furnishes
7272 LP-gas service only to itself, its employees, or its tenants as an
7373 incident of employment or tenancy, if the LP-gas service is not
7474 resold or used by others.
7575 SECTION 3. Subsection (a), Section 102.001, Utilities Code,
7676 is amended to read as follows:
7777 (a) The railroad commission has exclusive original
7878 jurisdiction over the rates and services of a gas utility:
7979 (1) that distributes natural gas, LP-gas, or synthetic
8080 natural gas in:
8181 (A) areas outside a municipality; and
8282 (B) areas inside a municipality that surrenders
8383 its jurisdiction to the railroad commission under Section 103.003;
8484 and
8585 (2) that transmits, transports, delivers, or sells
8686 natural gas, LP-gas, or synthetic natural gas to a gas utility that
8787 distributes the gas to the public.
8888 SECTION 4. Section 104.2545, Utilities Code, is amended by
8989 adding Subsection (e) to read as follows:
9090 (e) This section does not apply to an LP-gas utility.
9191 SECTION 5. Section 104.258, Utilities Code, is amended to
9292 read as follows:
9393 Sec. 104.258. DISCONNECTION OF NATURAL GAS OR LP-GAS [GAS]
9494 SERVICE. (a) In this section:
9595 (1) "Extreme weather emergency" means a period during
9696 which the previous day's highest temperature did not exceed 32
9797 degrees Fahrenheit and the temperature is predicted to remain at or
9898 below that level for the next 24 hours according to the nearest
9999 National Weather Service reports.
100100 (2) "Provider" means:
101101 (A) a gas utility, as defined by Sections 101.003
102102 and 121.001; [and]
103103 (B) an LP-gas utility, as defined by Section
104104 101.003; and
105105 (C) an owner, operator, or manager of a mobile
106106 home park or apartment who purchases natural gas or LP-gas through a
107107 master meter for delivery to a dwelling unit in a mobile home park
108108 or apartment house under Chapter 124.
109109 (b) A provider may not disconnect natural gas or LP-gas
110110 service to a residential customer on a weekend day unless personnel
111111 of the provider are available on that day to take payments and
112112 reconnect service.
113113 (c) A provider may not disconnect natural gas or LP-gas
114114 service to a residential customer during an extreme weather
115115 emergency. The provider shall defer collection of the full payment
116116 of bills that are due during an extreme weather emergency until
117117 after the emergency is over and shall work with customers to
118118 establish a pay schedule for deferred bills.
119119 SECTION 6. This Act takes effect September 1, 2011.
