99 AN ACT
1010 relating to the consolidation of more than one water or sewer system
1111 under a single tariff by an investor-owned utility.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subsection (a), Section 13.145, Water Code, is
1414 amended to read as follows:
1515 (a) A utility may consolidate more than one system under a
1616 single tariff only if:
1717 (1) the regulatory authority finds that, at the time
1818 the utility applies for a uniform tariff, all of the systems under
1919 the tariff are substantially similar in terms of facilities,
2020 quality of service, and cost of service; and
2121 (2) the tariff provides for rates that promote water
2222 conservation for single-family residences and landscape
2323 irrigation.
2424 SECTION 2. The changes in law made by this Act apply only to
2525 applications for a uniform tariff filed on or after the effective
2626 date of this Act. An application filed before the effective date of
2727 this Act is governed by the law in effect on the date the
2828 application is filed, and that law is continued in effect for this
2929 purpose.
3030 SECTION 3. This Act takes effect September 1, 2011.
