1212 AN ACT
1313 relating to the provision of affordable housing in colonias, rural
1414 communities, and small municipalities.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 ARTICLE 1. HOUSING IN COLONIAS, RURAL COMMUNITIES, AND SMALL
1717 MUNICIPALITIES
1818 SECTION 1.01. Subsections (a), (b), and (d), Section
1919 775.002, Government Code, are amended to read as follows:
2020 (a) Contingent on the legislature's appropriation of
2121 sufficient funds, the Texas Department of Housing and Community
2222 Affairs shall [The governor may] designate the office established
2323 under Section 2306.302 or another office within the department with
2424 a focus on matters relating to colonias [an agency] to act as the
2525 state's colonia initiatives coordinator.
2626 (b) The [If appointed under Subsection (a), the] colonia
2727 initiatives coordinator shall coordinate colonia initiatives
2828 within the Texas Department of Housing and Community Affairs
2929 [agency] and with the other agencies and local officials involved
3030 in colonia projects in the state.
3131 (d) The following agencies shall designate an officer or
3232 employee of the agency to serve as the agency's liaison for colonia
3333 initiatives:
3434 (1) the office of the attorney general;
3535 (2) the Department of State Health Services;
3636 (3) [the Texas Department of Housing and Community
3737 Affairs;
3838 [(4)] the Texas Commission on Environmental Quality;
3939 (4) [(5)] the Texas Water Development Board;
4040 (5) [(6)] the Texas Department of Rural Affairs;
4141 (6) [(7)] the Office of State-Federal Relations;
4242 (7) [(8)] the Texas Department of Insurance; and
4343 (8) [(9)] the Texas Department of Transportation.
4444 SECTION 1.02. Chapter 2306, Government Code, is amended by
4545 adding Subchapter N to read as follows:
4646 SUBCHAPTER N. OFFICE OF RURAL COMMUNITY AND SMALL MUNICIPALITY
4747 HOUSING INITIATIVES
4848 Sec. 2306.301. DEFINITION. In this subchapter, "office"
4949 means the office established by Section 2306.302 to support rural
5050 community and small municipality housing initiatives.
5151 Sec. 2306.302. ESTABLISHMENT OF OFFICE. (a) The
5252 department shall establish an office to support rural community and
5353 small municipality housing initiatives.
5454 (b) The department by rule shall define for purposes of this
5555 subchapter:
5656 (1) a rural community; and
5757 (2) a small municipality.
5858 (c) The office shall work with each regional council of
5959 government to:
6060 (1) match housing sponsors to the housing needs of
6161 rural communities and small municipalities; and
6262 (2) identify available sources of funds for those
6363 housing needs.
6464 (d) The office shall use funds available from the housing
6565 trust fund established under Section 2306.201 to administer
6666 capacity building programs for rural communities and small
6767 municipalities.
6868 (e) The office shall coordinate a meeting at least two times
6969 each year between department program directors and representatives
7070 of rural communities and small municipalities to discuss best
7171 practices for rural community and small municipality housing
7272 initiatives.
7373 (f) The office shall establish an online clearinghouse of
7474 information relating to best practices for rural community and
7575 small municipality housing initiatives.
7676 (g) Subject to available funding, the department by rule may
7777 establish as part of the office not more than seven field offices to
7878 assist political subdivisions and nonprofit entities in developing
7979 or administering affordable housing programs.
8080 (h) The department by rule shall specify the duties for any
8181 field office established under Subsection (g). The rules under
8282 this subsection must include the following duties for each field
8383 office:
8484 (1) identifying affordable housing needs for the area
8585 of the state in which the field office is located;
8686 (2) identifying state and federal programs that may
8787 address the needs identified under Subdivision (1);
8888 (3) facilitating the development of relationships
8989 that will assist in building local capacity to address the needs
9090 identified under Subdivision (1); and
9191 (4) providing information regarding state programs to
9292 assist in the development of affordable housing for the area of the
9393 state in which the field office is located.
9494 (i) The director may assign additional duties to the office.
9595 Sec. 2306.303. REGIONAL HOUSING DEVELOPMENT ORGANIZATIONS.
9696 (a) The office may establish regional nonprofit housing
9797 development organizations that serve rural communities and small
9898 municipalities in accordance with the purposes of this subchapter.
9999 (b) To implement this section, the department may use any
100100 money available to the department for the purposes of this
101101 subchapter, including gifts, grants, and donations and state and
102102 federal funds.
103103 Sec. 2306.304. TRAINING. (a) The office annually shall
104104 provide to elected officials, community organizations, nonprofit
105105 organizations, and private developers a training course that
106106 addresses housing programs and techniques that increase housing
107107 opportunities in rural communities and small municipalities. The
108108 office shall provide the course at an appropriate location selected
109109 by the office and shall make the course available online in real
110110 time.
111111 (b) The department periodically shall also provide to
112112 elected officials a training course regarding housing programs and
113113 sources of funding for those programs.
114114 Sec. 2306.305. HOUSING DEVELOPMENT PLANNING ASSISTANCE.
115115 (a) On the request of the commissioners court of a county, the
116116 office shall cooperate with and assist the county in:
117117 (1) developing comprehensive housing plans for rural
118118 communities and small municipalities in that county;
119119 (2) supporting housing development initiatives in
120120 those communities and municipalities; and
121121 (3) identifying financial resources available for
122122 those plans or initiatives.
123123 (b) On the request of the governing body of a small
124124 municipality, the office shall cooperate with and assist the
125125 municipality in:
126126 (1) developing a comprehensive housing plan for the
127127 municipality;
128128 (2) supporting housing development initiatives in the
129129 municipality; and
130130 (3) identifying financial resources available for the
131131 plan or initiatives.
132132 Sec. 2306.306. RURAL COMMUNITY AND SMALL MUNICIPALITY
133133 HOUSING DEVELOPMENT PILOT PROJECTS. Notwithstanding other program
134134 rules and procedures of the department, the department may
135135 establish pilot projects to test and develop new approaches to
136136 providing housing in rural communities and small municipalities
137137 for:
138138 (1) individuals and families of low income; and
139139 (2) individuals and families of very low income.
140140 Sec. 2306.307. AGRICULTURAL WORKER HOUSING INITIATIVE.
141141 (a) The office shall fund housing initiatives that serve
142142 agricultural workers and their families, including:
143143 (1) new housing initiatives;
144144 (2) housing rehabilitation initiatives; or
145145 (3) tenant-based rental assistance.
146146 (b) The office may designate as a pilot project a housing
147147 initiative implemented under this section for agricultural workers
148148 and their families.
149149 (c) The office shall coordinate with appropriate divisions
150150 of the department to:
151151 (1) document agricultural worker housing needs;
152152 (2) determine whether a housing need documented by the
153153 department is critical; and
154154 (3) develop initiatives to address those housing
155155 needs.
156156 (d) The department may use any available money to implement
157157 this section, including:
158158 (1) gifts, grants, and donations;
159159 (2) money in the housing trust fund; and
160160 (3) money allocated to the department under the
161161 federal HOME Investment Partnerships program established under
162162 Title II of the Cranston-Gonzalez National Affordable Housing Act
163163 (42 U.S.C. Section 12701 et seq.).
164164 (e) In this section, "agricultural worker":
165165 (1) means a person who receives a substantial portion
166166 of income from employment that involves:
167167 (A) the primary production of agricultural or
168168 aquacultural commodities; or
169169 (B) the handling of agricultural or aquacultural
170170 commodities in an unprocessed state, including handling those
171171 commodities in a feedlot or a meat processing plant; and
172172 (2) includes a person who is retired or disabled but
173173 was employed as described by Subdivision (1) at the time of that
174174 person's retirement or disablement.
175175 SECTION 1.03. Section 405.021, Government Code, is
176176 transferred to Subchapter Z, Chapter 2306, Government Code,
177177 redesignated as Section 2306.592, Government Code, and amended to
178178 read as follows:
179179 Sec. 2306.592 [405.021]. REPORT ON STATE-FUNDED PROJECTS
180180 SERVING COLONIAS. (a) Notwithstanding Section 2306.581, in [In]
181181 this section, "colonia" means a geographic area that:
182182 (1) is an economically distressed area as defined by
183183 Section 17.921, Water Code;
184184 (2) is located in a county any part of which is within
185185 62 miles of an international border; and
186186 (3) consists of 11 or more dwellings that are located
187187 in close proximity to each other in an area that may be described as
188188 a community or neighborhood.
189189 (b) Based on information provided under Subsections (c) and
190190 (d), the department [secretary of state] shall establish and
191191 maintain a classification system that allows the department
192192 [secretary of state] to track the progress of state-funded projects
193193 in providing water or wastewater services, paved roads, and other
194194 assistance to colonias.
195195 (c) The department [secretary of state] shall compile
196196 information received from offices within the department, the Texas
197197 Department of Rural Affairs, the Texas Water Development Board, the
198198 Texas Transportation Commission, [the Texas Department of Housing
199199 and Community Affairs,] the Department of State Health Services,
200200 the Texas Commission on Environmental Quality, the Health and Human
201201 Services Commission, the Texas Cooperative Extension, councils of
202202 governments, an institution of higher education that receives
203203 funding from the state for projects that provide assistance to
204204 colonias, and any other agency considered appropriate by the
205205 department [secretary of state] for purposes of the classification
206206 system.
207207 (d) The department [secretary of state] shall compile
208208 information on colonias that is received from the colonia
209209 ombudspersons under Section 775.004.
210210 (e) The department [secretary of state] shall:
211211 (1) with the assistance of the office of the attorney
212212 general, prepare a report on the progress of state-funded projects
213213 in providing water or wastewater services, paved roads, and other
214214 assistance to colonias; and
215215 (2) submit the report to the presiding officer of each
216216 house of the legislature not later than:
217217 (A) December 1 of each even-numbered year, if
218218 funds are appropriated specifically for the purpose of preparing
219219 and submitting the report; or
220220 (B) if funds are not appropriated as described by
221221 Paragraph (A), December 1, 2010, and December 1 of every fourth year
222222 following that date.
223223 (f) The report to the legislature must include a list of
224224 colonias with the highest health risk to colonia residents, based
225225 on factors identified by the department [secretary of state].
226226 (g) In conjunction with the establishment of the
227227 classification system required by this section, the department
228228 [secretary of state] shall establish and maintain a statewide
229229 system for identifying colonias.
230230 (h) The department [secretary of state] may contract with a
231231 third party to develop the classification system or the
232232 identification system or to compile or maintain the relevant
233233 information required by this section.
234234 ARTICLE 2. CONFORMING AMENDMENTS
235235 SECTION 2.01. The heading to Section 51.0052, Education
236236 Code, is amended to read as follows:
237237 Sec. 51.0052. REPORT TO TEXAS DEPARTMENT OF HOUSING AND
238238 COMMUNITY AFFAIRS [SECRETARY OF STATE].
239239 SECTION 2.02. Subsections (b), (c), and (d), Section
240240 51.0052, Education Code, are amended to read as follows:
241241 (b) To assist the Texas Department of Housing and Community
242242 Affairs [secretary of state] in preparing the report required under
243243 Section 2306.592 [405.021], Government Code, an institution of
244244 higher education on a quarterly basis shall provide a report to the
245245 Texas Department of Housing and Community Affairs [secretary of
246246 state] detailing any projects funded by the institution of higher
247247 education that provide assistance to colonias.
248248 (c) The report must include:
249249 (1) a description of any relevant projects;
250250 (2) the location of each project;
251251 (3) the number of colonia residents served by each
252252 project;
253253 (4) the exact amount spent or the anticipated amount
254254 to be spent on each colonia served by each project;
255255 (5) a statement of whether each project is completed
256256 and, if not, the expected completion date of the project; and
257257 (6) any other information, as determined appropriate
258258 by the Texas Department of Housing and Community Affairs [secretary
259259 of state].
260260 (d) The institution of higher education shall require an
261261 applicant for funds administered by the institution to submit to
262262 the institution a colonia classification number, if one exists, for
263263 each colonia that may be served by the project proposed in the
264264 application. If a colonia does not have a classification number,
265265 the institution of higher education may contact the Texas
266266 Department of Housing and Community Affairs [secretary of state or
267267 the secretary of state's representative] to obtain the
268268 classification number. On request of the institution, the Texas
269269 Department of Housing and Community Affairs [secretary of state or
270270 the secretary of state's representative] shall assign a
271271 classification number to the colonia.
272272 SECTION 2.03. The heading to Section 487.060, Government
273273 Code, is amended to read as follows:
274274 Sec. 487.060. REPORT TO TEXAS DEPARTMENT OF HOUSING AND
275275 COMMUNITY AFFAIRS [SECRETARY OF STATE].
276276 SECTION 2.04. Subsections (b), (c), and (d), Section
277277 487.060, Government Code, are amended to read as follows:
278278 (b) To assist the Texas Department of Housing and Community
279279 Affairs [secretary of state] in preparing the report required under
280280 Section 2306.592 [405.021], the department on a quarterly basis
281281 shall provide a report to the Texas Department of Housing and
282282 Community Affairs [secretary of state] detailing any projects
283283 funded by the department that serve colonias by providing water or
284284 wastewater services, paved roads, or other assistance.
285285 (c) The report must include:
286286 (1) a description of any relevant projects;
287287 (2) the location of each project;
288288 (3) the number of colonia residents served by each
289289 project;
290290 (4) the exact amount spent or the anticipated amount
291291 to be spent on each colonia served by each project;
292292 (5) a statement of whether each project is completed
293293 and, if not, the expected completion date of the project; and
294294 (6) any other information, as determined appropriate
295295 by the Texas Department of Housing and Community Affairs [secretary
296296 of state].
297297 (d) The department shall require an applicant for funds
298298 administered by the department to submit to the department a
299299 colonia classification number, if one exists, for each colonia that
300300 may be served by the project proposed in the application. If a
301301 colonia does not have a classification number, the department may
302302 contact the Texas Department of Housing and Community Affairs
303303 [secretary of state or the secretary of state's representative] to
304304 obtain a number. On request of the department, the Texas Department
305305 of Housing and Community Affairs [secretary of state or the
306306 secretary of state's representative] shall assign a classification
307307 number.
308308 SECTION 2.05. The heading to Section 531.0141, Government
309309 Code, is amended to read as follows:
310310 Sec. 531.0141. REPORT TO TEXAS DEPARTMENT OF HOUSING AND
311311 COMMUNITY AFFAIRS [SECRETARY OF STATE].
312312 SECTION 2.06. Subsections (b), (c), and (d), Section
313313 531.0141, Government Code, are amended to read as follows:
314314 (b) To assist the Texas Department of Housing and Community
315315 Affairs [secretary of state] in preparing the report required under
316316 Section 2306.592 [405.021], the commission on a quarterly basis
317317 shall provide a report to the Texas Department of Housing and
318318 Community Affairs [secretary of state] detailing any projects
319319 funded by the commission that provide assistance to colonias.
320320 (c) The report must include:

332332 (d) The commission shall require an applicant for funds
333333 administered by the commission to submit to the commission a
334334 colonia classification number, if one exists, for each colonia that
335335 may be served by the project proposed in the application. If a
336336 colonia does not have a classification number, the commission may
337337 contact the Texas Department of Housing and Community Affairs
338338 [secretary of state or the secretary of state's representative] to
339339 obtain the classification number. On request of the commission,
340340 the Texas Department of Housing and Community Affairs [secretary of
341341 state or the secretary of state's representative] shall assign a
342342 classification number to the colonia.
343343 SECTION 2.07. Subsections (a), (b), and (c), Section
344344 775.004, Government Code, are amended to read as follows:
345345 (a) The colonia ombudspersons shall gather information
346346 about the colonias in the counties for which the ombudspersons were
347347 appointed and provide the information to the Texas Department of
348348 Housing and Community Affairs [secretary of state], to assist the
349349 Texas Department of Housing and Community Affairs [secretary of
350350 state] in preparing the report required under Section 2306.592
351351 [405.021].
352352 (b) To the extent possible, the ombudspersons shall gather
353353 information regarding:
354354 (1) the platting of each colonia;
355355 (2) the infrastructure of each colonia;
356356 (3) the availability of health care services;
357357 (4) the availability of financial assistance; and
358358 (5) any other appropriate topic as requested by the
359359 Texas Department of Housing and Community Affairs [secretary of
360360 state].
361361 (c) The ombudspersons shall provide the information to the
362362 Texas Department of Housing and Community Affairs [secretary of
363363 state] not later than September 1 of each even-numbered year.
364364 SECTION 2.08. The heading to Section 1001.033, Health and
365365 Safety Code, is amended to read as follows:
366366 Sec. 1001.033. REPORT TO TEXAS DEPARTMENT OF HOUSING AND
367367 COMMUNITY AFFAIRS [SECRETARY OF STATE].
368368 SECTION 2.09. Subsections (b), (c), and (d), Section
369369 1001.033, Health and Safety Code, are amended to read as follows:

389389 (d) The commission shall require an applicant for funds
390390 administered by the commission to submit to the commission a
391391 colonia classification number, if one exists, for each colonia that
392392 may be served by the project proposed in the application. If a
393393 colonia does not have a classification number, the commission may
394394 contact the Texas Department of Housing and Community Affairs
395395 [secretary of state or the secretary of state's representative] to
396396 obtain the classification number. On request of the commission,
397397 the Texas Department of Housing and Community Affairs [secretary of
398398 state or the secretary of state's representative] shall assign a
399399 classification number to the colonia.
400400 SECTION 2.10. The heading to Section 391.00951, Local
401401 Government Code, is amended to read as follows:

440440 SECTION 2.13. Subsections (b), (c), and (d), Section
441441 201.116, Transportation Code, are amended to read as follows:
442442 (b) To assist the Texas Department of Housing and Community
443443 Affairs [secretary of state] in preparing the report required under
444444 Section 2306.592 [405.021], Government Code, the commission on a
445445 quarterly basis shall provide a report to the Texas Department of
446446 Housing and Community Affairs [secretary of state] detailing any
447447 projects funded by the department that serve colonias by providing
448448 paved roads or other assistance.
449449 (c) The report must include:
450450 (1) a description of any relevant projects;
451451 (2) the location of each project;
452452 (3) the number of colonia residents served by each

510510 Sec. 6.1565. REPORT TO TEXAS DEPARTMENT OF HOUSING AND
511511 COMMUNITY AFFAIRS [SECRETARY OF STATE].
512512 SECTION 2.17. Subsections (b), (c), and (d), Section
513513 6.1565, Water Code, are amended to read as follows:
514514 (b) To assist the Texas Department of Housing and Community
515515 Affairs [secretary of state] in preparing the report required under
516516 Section 2306.592 [405.021], Government Code, the board on a
517517 quarterly basis shall provide a report to the Texas Department of
518518 Housing and Community Affairs [secretary of state] detailing any
519519 projects funded by the board that serve colonias by providing water
520520 or wastewater services or other assistance.
521521 (c) The report must include:
522522 (1) a description of any relevant projects;
523523 (2) the location of each project;
524524 (3) the number of colonia residents served by each
525525 project;
526526 (4) the exact amount spent or the anticipated amount
527527 to be spent on each colonia served by each project;
528528 (5) a statement of whether each project is completed
529529 and, if not, the expected completion date of the project; and
530530 (6) any other information, as determined appropriate
531531 by the Texas Department of Housing and Community Affairs [secretary
532532 of state].
533533 (d) The board shall require an applicant for funds
534534 administered by the board to submit to the board a colonia
535535 classification number, if one exists, for each colonia that may be
536536 served by the project proposed in the application. If a colonia
537537 does not have a classification number, the board may contact the
538538 Texas Department of Housing and Community Affairs [secretary of
539539 state or the secretary of state's representative] to obtain the
540540 classification number. On request of the board, the Texas
541541 Department of Housing and Community Affairs [secretary of state or
542542 the secretary of state's representative] shall assign a
543543 classification number to the colonia.
544544 ARTICLE 3. REPEALER, TRANSITION, AND EFFECTIVE DATE
545545 SECTION 3.01. Section 2306.083, Government Code, is
546546 repealed.
547547 SECTION 3.02. (a) Not later than October 1, 2011, the
548548 Texas Department of Housing and Community Affairs shall adopt the
549549 rules required by Subchapter N, Chapter 2306, Government Code, as
550550 added by this Act.
551551 (b) As soon as practicable after the effective date of this
552552 Act, the Texas Department of Housing and Community Affairs shall
553553 establish the classification system required by Subsection (b),
554554 Section 2306.592, Government Code, as designated and amended by
555555 this Act. For purposes of this subsection, the department may use
556556 an applicable classification system already in effect.
557557 SECTION 3.03. This Act takes effect September 1, 2011.
