99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle I, Title 6, Special District Local Laws
1111 Code, is amended by adding Chapter 9035 to read as follows:
1212 CHAPTER 9035. CROCKETT COUNTY WATER CONTROL AND IMPROVEMENT
1313 DISTRICT NO. 1
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 9035.001. DEFINITIONS. In this chapter:
1616 (1) "Board" means the district's board of directors.
1717 (2) "Director" means a board member.
1818 (3) "District" means the Crockett County Water Control
1919 and Improvement District No. 1.

2121 SUBCHAPTER B. BOARD OF DIRECTORS
2222 Sec. 9035.051. ELECTION OF DIRECTORS. (a) Notwithstanding
2323 Section 49.103(b), Water Code, on the uniform election date in
2424 November of each even-numbered year, the district shall hold an
2525 election to elect the appropriate number of directors to the board.
2626 (b) The election may be held at any location that is in the
2727 boundaries of:
2828 (1) the district; and
2929 (2) Crockett County.
3030 SECTION 2. (a) All governmental acts and proceedings of
3131 the Crockett County Water Control and Improvement District No. 1
3232 relating to the election of members of the board of directors of the
3333 district that were taken before the effective date of this Act are
3434 validated, ratified, and confirmed in all respects as if they had
3535 been taken as authorized by law.
3636 (b) This section does not apply to any matter that on the
3737 effective date of this Act:
3838 (1) is involved in litigation if the litigation
3939 ultimately results in the matter being held invalid by a final court
4040 judgment; or
4141 (2) has been held invalid by a final court judgment.
4242 SECTION 3. A director of the board of the Crockett County
4343 Water Control and Improvement District No. 1 who is serving on the
4444 day before the effective date of this Act shall serve until the
4545 director's term expires. A director whose term expires in May 2012
4646 shall serve until the director's successor has qualified following
4747 the directors' election held on the uniform election date in
4848 November 2012 in accordance with Section 9035.051, Special District
4949 Local Laws Code, as added by this Act. A director whose term
5050 expires in May 2014 shall serve until the director's successor has
5151 qualified following the directors' election held on the uniform
5252 election date in November 2014.
5353 SECTION 4. (a) The legal notice of the intention to
5454 introduce this Act, setting forth the general substance of this
5555 Act, has been published as provided by law, and the notice and a
5656 copy of this Act have been furnished to all persons, agencies,
5757 officials, or entities to which they are required to be furnished
5858 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5959 Government Code.
6060 (b) The governor, one of the required recipients, has
6161 submitted the notice and Act to the Texas Commission on
6262 Environmental Quality.
6363 (c) The Texas Commission on Environmental Quality has filed
6464 its recommendations relating to this Act with the governor, the
6565 lieutenant governor, and the speaker of the house of
6666 representatives within the required time.
6767 (d) All requirements of the constitution and laws of this
6868 state and the rules and procedures of the legislature with respect
6969 to the notice, introduction, and passage of this Act are fulfilled
7070 and accomplished.
7171 SECTION 5. This Act takes effect immediately if it receives
7272 a vote of two-thirds of all the members elected to each house, as
7373 provided by Section 39, Article III, Texas Constitution. If this
7474 Act does not receive the vote necessary for immediate effect, this
7575 Act takes effect September 1, 2011.
