| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle I, Title 6, Special District Local Laws |
|---|
| 11 | 11 | | Code, is amended by adding Chapter 9035 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 9035. CROCKETT COUNTY WATER CONTROL AND IMPROVEMENT |

| 13 | 13 | | DISTRICT NO. 1 |
|---|
| 14 | 14 | | SUBCHAPTER A. GENERAL PROVISIONS |
|---|
| 15 | 15 | | Sec. 9035.001. DEFINITIONS. In this chapter: |
|---|
| 16 | 16 | | (1) "Board" means the district's board of directors. |
|---|
| 17 | 17 | | (2) "Director" means a board member. |
|---|
| 18 | 18 | | (3) "District" means the Crockett County Water Control |
|---|
| 19 | 19 | | and Improvement District No. 1. |
|---|
| 20 | 20 | | [Sections 9035.002-9035.050 reserved for expansion] |

| 21 | 21 | | SUBCHAPTER B. BOARD OF DIRECTORS |
|---|
| 22 | 22 | | Sec. 9035.051. ELECTION OF DIRECTORS. (a) Notwithstanding |
|---|
| 23 | 23 | | Section 49.103(b), Water Code, on the uniform election date in |
|---|
| 24 | 24 | | November of each even-numbered year, the district shall hold an |
|---|
| 25 | 25 | | election to elect the appropriate number of directors to the board. |
|---|
| 26 | 26 | | (b) The election may be held at any location that is in the |
|---|
| 27 | 27 | | boundaries of: |
|---|
| 28 | 28 | | (1) the district; and |
|---|
| 29 | 29 | | (2) Crockett County. |
|---|
| 30 | 30 | | SECTION 2. (a) All governmental acts and proceedings of |
|---|
| 31 | 31 | | the Crockett County Water Control and Improvement District No. 1 |
|---|
| 32 | 32 | | relating to the election of members of the board of directors of the |
|---|
| 33 | 33 | | district that were taken before the effective date of this Act are |
|---|
| 34 | 34 | | validated, ratified, and confirmed in all respects as if they had |
|---|
| 35 | 35 | | been taken as authorized by law. |
|---|
| 36 | 36 | | (b) This section does not apply to any matter that on the |
|---|
| 37 | 37 | | effective date of this Act: |
|---|
| 38 | 38 | | (1) is involved in litigation if the litigation |
|---|
| 39 | 39 | | ultimately results in the matter being held invalid by a final court |
|---|
| 40 | 40 | | judgment; or |
|---|
| 41 | 41 | | (2) has been held invalid by a final court judgment. |
|---|
| 42 | 42 | | SECTION 3. A director of the board of the Crockett County |
|---|
| 43 | 43 | | Water Control and Improvement District No. 1 who is serving on the |
|---|
| 44 | 44 | | day before the effective date of this Act shall serve until the |
|---|
| 45 | 45 | | director's term expires. A director whose term expires in May 2012 |
|---|
| 46 | 46 | | shall serve until the director's successor has qualified following |
|---|
| 47 | 47 | | the directors' election held on the uniform election date in |
|---|
| 48 | 48 | | November 2012 in accordance with Section 9035.051, Special District |
|---|
| 49 | 49 | | Local Laws Code, as added by this Act. A director whose term |
|---|
| 50 | 50 | | expires in May 2014 shall serve until the director's successor has |
|---|
| 51 | 51 | | qualified following the directors' election held on the uniform |
|---|
| 52 | 52 | | election date in November 2014. |
|---|
| 53 | 53 | | SECTION 4. (a) The legal notice of the intention to |
|---|
| 54 | 54 | | introduce this Act, setting forth the general substance of this |
|---|
| 55 | 55 | | Act, has been published as provided by law, and the notice and a |
|---|
| 56 | 56 | | copy of this Act have been furnished to all persons, agencies, |
|---|
| 57 | 57 | | officials, or entities to which they are required to be furnished |
|---|
| 58 | 58 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
|---|
| 59 | 59 | | Government Code. |
|---|
| 60 | 60 | | (b) The governor, one of the required recipients, has |
|---|
| 61 | 61 | | submitted the notice and Act to the Texas Commission on |
|---|
| 62 | 62 | | Environmental Quality. |
|---|
| 63 | 63 | | (c) The Texas Commission on Environmental Quality has filed |
|---|
| 64 | 64 | | its recommendations relating to this Act with the governor, the |
|---|
| 65 | 65 | | lieutenant governor, and the speaker of the house of |
|---|
| 66 | 66 | | representatives within the required time. |
|---|
| 67 | 67 | | (d) All requirements of the constitution and laws of this |
|---|
| 68 | 68 | | state and the rules and procedures of the legislature with respect |
|---|
| 69 | 69 | | to the notice, introduction, and passage of this Act are fulfilled |
|---|
| 70 | 70 | | and accomplished. |
|---|
| 71 | 71 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 72 | 72 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 73 | 73 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 74 | 74 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 75 | 75 | | Act takes effect September 1, 2011. |
