88 A BILL TO BE ENTITLED
99 AN ACT
1010 relating to the sale of souvenir bottles of distilled spirits by the
1111 holder of a distiller's and rectifier's permit.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subsection (a), Section 14.01, Alcoholic
1414 Beverage Code, is amended to read as follows:
1515 (a) The holder of a distiller's and rectifier's permit may:
1616 (1) manufacture distilled spirits;
1717 (2) rectify, purify, and refine distilled spirits and
1818 wines;
1919 (3) mix wines, distilled spirits, or other liquors;
2020 (4) bottle, label, and package the permit holder's
2121 finished products;
2222 (5) sell the finished products in this state to
2323 holders of wholesaler's permits and to qualified persons outside
2424 the state;
2525 (6) import distilled spirits, to be used only for
2626 manufacturing or rectification purposes, from holders of
2727 nonresident seller's permits; [and]
2828 (7) dispense free distilled spirits for consumption on
2929 the permitted premises; and
3030 (8) sell souvenir bottles of distilled spirits to
3131 ultimate consumers for off-premises consumption in accordance with
3232 Section 14.05.
3333 SECTION 2. Chapter 14, Alcoholic Beverage Code, is amended
3434 by adding Section 14.05 to read as follows:
3535 Sec. 14.05. SOUVENIR BOTTLE SALES. (a) The holder of a
3636 distiller's and rectifier's permit whose premises are located in an
3737 area where the sale of distilled spirits is legal may sell souvenir
3838 bottles of distilled spirits manufactured or bottled on the
3939 permitted premises to ultimate consumers in unbroken packages for
4040 off-premises consumption.
4141 (b) A consumer may not purchase more than one souvenir
4242 bottle per visit of each brand of distilled spirits manufactured or
4343 bottled on the permitted premises.
4444 (c) A permit holder may not sell more than 50,000 gallons of
4545 distilled spirits under this section annually.
4646 (d) Distilled spirits sold under this section must be sold
4747 in container sizes that meet commission rules and that are labeled,
4848 stamped, or otherwise designed differently than the containers the
4949 permittee sells to wholesalers.
5050 (e) A person authorized to sell distilled spirits under this
5151 section may not sell a souvenir bottle of distilled spirits to a
5252 minor or to an obviously intoxicated person.
5353 SECTION 3. This Act takes effect September 1, 2011.
