| 9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subsection (b), Section 65, Article XVI, Texas |
|---|
| 11 | 11 | | Constitution, is amended to read as follows: |
|---|
| 12 | 12 | | (b) If any of the officers named herein shall announce their |
|---|
| 13 | 13 | | candidacy, or shall in fact become a candidate, in any General, |
|---|
| 14 | 14 | | Special or Primary Election, for any office of profit or trust under |
|---|
| 15 | 15 | | the laws of this State or the United States other than the office |
|---|
| 16 | 16 | | then held, at any time when the unexpired term of the office then |
|---|
| 17 | 17 | | held shall exceed one [(1)] year and 30 days, such announcement or |
|---|
| 18 | 18 | | such candidacy shall constitute an automatic resignation of the |
|---|
| 19 | 19 | | office then held, and the vacancy thereby created shall be filled |
|---|
| 20 | 20 | | pursuant to law in the same manner as other vacancies for such |
|---|
| 21 | 21 | | office are filled. |

| 22 | 22 | | SECTION 2. (a) This proposed constitutional amendment |
|---|
| 23 | 23 | | shall be submitted to the voters at an election to be held November |
|---|
| 24 | 24 | | 8, 2011, only if the secretary of state certifies that an enactment |
|---|
| 25 | 25 | | of the 82nd Legislature, Regular Session, that became law provides |
|---|
| 26 | 26 | | for a filing deadline for an application for a place on the general |
|---|
| 27 | 27 | | primary ballot that occurs in the calendar year before the year in |
|---|
| 28 | 28 | | which the primary is held. If the secretary of state does not make a |
|---|
| 29 | 29 | | certification under this subsection, this resolution has no effect. |

| 30 | 30 | | (b) If the election on this amendment is held, the ballot |
|---|
| 31 | 31 | | shall be printed to permit voting for or against the proposition: |
|---|
| 32 | 32 | | "The constitutional amendment to change the length of the unexpired |
|---|
| 33 | 33 | | term that causes the automatic resignation of certain elected |
|---|
| 34 | 34 | | county or district officeholders if they become candidates for |
|---|
| 35 | 35 | | another office." |
