99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (b), Section 65, Article XVI, Texas
1111 Constitution, is amended to read as follows:
1212 (b) If any of the officers named herein shall announce their
1313 candidacy, or shall in fact become a candidate, in any General,
1414 Special or Primary Election, for any office of profit or trust under
1515 the laws of this State or the United States other than the office
1616 then held, at any time when the unexpired term of the office then
1717 held shall exceed one [(1)] year and 30 days, such announcement or
1818 such candidacy shall constitute an automatic resignation of the
1919 office then held, and the vacancy thereby created shall be filled
2020 pursuant to law in the same manner as other vacancies for such
2121 office are filled.
2222 SECTION 2. (a) This proposed constitutional amendment
2323 shall be submitted to the voters at an election to be held November
2424 8, 2011, only if the secretary of state certifies that an enactment
2525 of the 82nd Legislature, Regular Session, that became law provides
2626 for a filing deadline for an application for a place on the general
2727 primary ballot that occurs in the calendar year before the year in
2828 which the primary is held. If the secretary of state does not make a
2929 certification under this subsection, this resolution has no effect.
3030 (b) If the election on this amendment is held, the ballot
3131 shall be printed to permit voting for or against the proposition:
3232 "The constitutional amendment to change the length of the unexpired
3333 term that causes the automatic resignation of certain elected
3434 county or district officeholders if they become candidates for
3535 another office."
