88 A BILL TO BE ENTITLED
99 AN ACT
1010 relating to the establishment of community partnerships and the
1111 development of policy recommendations for increasing physical
1212 activity and improving fitness among public school students.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 28.004, Education Code, is amended by
1515 amending Subsections (c) and (m) and adding Subsections (l-1) and
1616 (n) to read as follows:
1717 (c) The local school health advisory council's duties
1818 include recommending:
1919 (1) the number of hours of instruction to be provided
2020 in health education;
2121 (2) curriculum appropriate for specific grade levels
2222 designed to prevent obesity, cardiovascular disease, and Type 2
2323 diabetes through coordination of:
2424 (A) health education;
2525 (B) physical education and physical activity;
2626 (C) nutrition services;
2727 (D) parental involvement; and
2828 (E) instruction to prevent the use of tobacco;
2929 (3) appropriate grade levels and methods of
3030 instruction for human sexuality instruction; [and]
3131 (4) strategies for integrating the curriculum
3232 components specified by Subdivision (2) with the following elements
3333 in a coordinated school health program for the district:
3434 (A) school health services;
3535 (B) counseling and guidance services;
3636 (C) a safe and healthy school environment; and
3737 (D) school employee wellness; and
3838 (5) if feasible, joint use agreements or strategies
3939 for collaboration between the school district and community
4040 organizations or agencies.
4141 (l-1) The local school health advisory council shall
4242 establish a physical activity and fitness planning subcommittee to
4343 consider issues relating to student physical activity and fitness
4444 and make policy recommendations to increase physical activity and
4545 improve fitness among students.
4646 (m) In addition to performing other duties, the local school
4747 health advisory council shall submit to the board of trustees, at
4848 least annually, a written report that includes:
4949 (1) any council recommendation concerning the school
5050 district's health education curriculum and instruction or related
5151 matters that the council has not previously submitted to the board;
5252 (2) any suggested modification to a council
5353 recommendation previously submitted to the board; [and]
5454 (3) a detailed explanation of the council's activities
5555 during the period between the date of the current report and the
5656 date of the last prior written report; and
5757 (4) any recommendations made by the physical activity
5858 and fitness planning subcommittee.
5959 (n) Any joint use agreement that a school district and
6060 community organization or agency enter into based on a
6161 recommendation of the local school health advisory council under
6262 Subsection (c)(5) must address liability for the school district
6363 and community organization or agency in the agreement.
6464 SECTION 2. This Act takes effect September 1, 2013.
