10 | 10 | | relating to the establishment of community partnerships and the |
---|
11 | 11 | | development of policy recommendations for increasing physical |
---|
12 | 12 | | activity and improving fitness among public school students. |
---|
13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Section 28.004, Education Code, is amended by |
---|
15 | 15 | | amending Subsections (c) and (m) and adding Subsections (l-1) and |
---|
16 | 16 | | (n) to read as follows: |
---|
17 | 17 | | (c) The local school health advisory council's duties |
---|
18 | 18 | | include recommending: |
---|
19 | 19 | | (1) the number of hours of instruction to be provided |
---|
20 | 20 | | in health education; |
---|
21 | 21 | | (2) curriculum appropriate for specific grade levels |
---|
22 | 22 | | designed to prevent obesity, cardiovascular disease, and Type 2 |
---|
23 | 23 | | diabetes through coordination of: |
---|
24 | 24 | | (A) health education; |
---|
25 | 25 | | (B) physical education and physical activity; |
---|
26 | 26 | | (C) nutrition services; |
---|
27 | 27 | | (D) parental involvement; and |
---|
28 | 28 | | (E) instruction to prevent the use of tobacco; |
---|
29 | 29 | | (3) appropriate grade levels and methods of |
---|
30 | 30 | | instruction for human sexuality instruction; [and] |
---|
31 | 31 | | (4) strategies for integrating the curriculum |
---|
32 | 32 | | components specified by Subdivision (2) with the following elements |
---|
33 | 33 | | in a coordinated school health program for the district: |
---|
34 | 34 | | (A) school health services; |
---|
35 | 35 | | (B) counseling and guidance services; |
---|
36 | 36 | | (C) a safe and healthy school environment; and |
---|
37 | 37 | | (D) school employee wellness; and |
---|
38 | 38 | | (5) if feasible, joint use agreements or strategies |
---|
39 | 39 | | for collaboration between the school district and community |
---|
40 | 40 | | organizations or agencies. |
---|
41 | 41 | | (l-1) The local school health advisory council shall |
---|
42 | 42 | | establish a physical activity and fitness planning subcommittee to |
---|
43 | 43 | | consider issues relating to student physical activity and fitness |
---|
44 | 44 | | and make policy recommendations to increase physical activity and |
---|
45 | 45 | | improve fitness among students. |
---|
46 | 46 | | (m) In addition to performing other duties, the local school |
---|
47 | 47 | | health advisory council shall submit to the board of trustees, at |
---|
48 | 48 | | least annually, a written report that includes: |
---|
49 | 49 | | (1) any council recommendation concerning the school |
---|
50 | 50 | | district's health education curriculum and instruction or related |
---|
51 | 51 | | matters that the council has not previously submitted to the board; |
---|
52 | 52 | | (2) any suggested modification to a council |
---|
53 | 53 | | recommendation previously submitted to the board; [and] |
---|
54 | 54 | | (3) a detailed explanation of the council's activities |
---|
55 | 55 | | during the period between the date of the current report and the |
---|
56 | 56 | | date of the last prior written report; and |
---|
57 | 57 | | (4) any recommendations made by the physical activity |
---|
58 | 58 | | and fitness planning subcommittee. |
---|
59 | 59 | | (n) Any joint use agreement that a school district and |
---|
60 | 60 | | community organization or agency enter into based on a |
---|
61 | 61 | | recommendation of the local school health advisory council under |
---|
62 | 62 | | Subsection (c)(5) must address liability for the school district |
---|
63 | 63 | | and community organization or agency in the agreement. |
---|
64 | 64 | | SECTION 2. This Act takes effect September 1, 2013. |
