77 relating to the use of state institutions of higher education to
88 provide training to state agency employees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 656.043, Government Code, is amended to
1111 read as follows:
1212 Sec. 656.043. DEFINITIONS [DEFINITION]. In this
1313 subchapter:
1414 (1) "Institution of higher education" has the meaning
1515 assigned by Section 61.003, Education Code.
1616 (2) "State[, "state] agency" means a department,
1717 agency, or institution of this state, including an institution of
1818 higher education [as defined by Section 61.003, Education Code].
1919 SECTION 2. Section 656.049, Government Code, is amended to
2020 read as follows:
2121 Sec. 656.049. AUTHORITY TO CONTRACT. (a) A state agency
2222 may contract with another state, local, or federal department,
2323 agency, or institution, including a state-supported college or
2424 university, to train or educate its administrators and employees or
2525 may join in presenting a training or educational program.
2626 (b) A state agency may not contract with a private person to
2727 train or educate a state agency administrator or employee if the
2828 agency is required under Section 656.050 to use an institution of
2929 higher education to provide the training or education.
3030 SECTION 3. Subchapter C, Chapter 656, Government Code, is
3131 amended by adding Section 656.050 to read as follows:
3232 Sec. 656.050. TRAINING PROVIDED BY INSTITUTIONS OF HIGHER
3333 EDUCATION. (a) A state agency shall use an institution of higher
3434 education to provide training or education to its administrators
3535 and employees if the institution can provide the training or
3636 education:
3737 (1) at a comparable level of quality but at a lower
3838 cost to the agency;
3939 (2) on the subject matter required by the state
4040 agency;
4141 (3) in the geographic area in which the state agency
4242 administrator or employee is located;
4343 (4) not later than the date the agency requires the
4444 training or education to be completed; and
4545 (5) according to a schedule acceptable to the agency.
4646 (b) A state agency may use an institution of higher
4747 education to supplement or enhance the training or education
4848 provided by full-time state agency employees to the agency's other
4949 employees.
5050 SECTION 4. Section 656.049, Government Code, as amended by
5151 this Act, applies only to a contract entered into on or after the
5252 effective date of this Act. A contract entered into before the
5353 effective date of this Act is covered by the law in effect when the
5454 contract was entered into, and the former law is continued in effect
5555 for that purpose.
5656 SECTION 5. This Act takes effect September 1, 2013.
