99 AN ACT
1010 relating to the Texas Racing Commission's ability to share
1111 investigatory information with other state regulatory agencies.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 2.15, Texas Racing Act (Article 179e,
1414 Vernon's Texas Civil Statutes), is amended to read as follows:
1515 Sec. 2.15. RECORDS. (a) All records of the commission that
1616 are not made confidential by other law are open to inspection by the
1717 public during regular office hours. All applications for a license
1818 under this Act shall be maintained by the commission and shall be
1919 available for public inspection during regular office hours.
2020 (b) The contents of the investigatory files of the
2121 commission[, however,] are not public records and are confidential
2222 except in a criminal proceeding, in a hearing conducted by the
2323 commission, on court order, or with the consent of the party being
2424 investigated.
2525 (c) The commission may share with another regulatory agency
2626 of this state any investigatory file information that creates a
2727 reasonable suspicion of a person's violation of a law or rule under
2828 that agency's jurisdiction. The agency may use the information as
2929 if it was obtained through that agency's investigatory process.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2013.
