| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 2.15, Texas Racing Act (Article 179e, |
|---|
| 14 | 14 | | Vernon's Texas Civil Statutes), is amended to read as follows: |

| 15 | 15 | | Sec. 2.15. RECORDS. (a) All records of the commission that |
|---|
| 16 | 16 | | are not made confidential by other law are open to inspection by the |
|---|
| 17 | 17 | | public during regular office hours. All applications for a license |
|---|
| 18 | 18 | | under this Act shall be maintained by the commission and shall be |
|---|
| 19 | 19 | | available for public inspection during regular office hours. |
|---|
| 20 | 20 | | (b) The contents of the investigatory files of the |
|---|
| 21 | 21 | | commission[, however,] are not public records and are confidential |
|---|
| 22 | 22 | | except in a criminal proceeding, in a hearing conducted by the |
|---|
| 23 | 23 | | commission, on court order, or with the consent of the party being |
|---|
| 24 | 24 | | investigated. |

| 25 | 25 | | (c) The commission may share with another regulatory agency |
|---|
| 26 | 26 | | of this state any investigatory file information that creates a |
|---|
| 27 | 27 | | reasonable suspicion of a person's violation of a law or rule under |
|---|
| 28 | 28 | | that agency's jurisdiction. The agency may use the information as |
|---|
| 29 | 29 | | if it was obtained through that agency's investigatory process. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2013. |
