| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Article 103.0033, Code of Criminal Procedure, is | |
| 12 | 12 | amended by amending Subsection (b) and adding Subsection (b-1) to | |
| 13 | 13 | read as follows: | |
| 14 | 14 | (b) Except as provided by Subsection (b-1), this [This] | |
| 15 | 15 | article applies only to: | |
| 16 | 16 | (1) a county with a population of 50,000 or greater; | |
| 17 | 17 | and | |
| 18 | 18 | (2) a municipality with a population of 100,000 or | |
| 19 | 19 | greater. | |
| 20 | 20 | (b-1) This article does not apply to a county with a | |
| 21 | 21 | population of less than 55,000 that contains a hospital owned and | |
| 22 | 22 | operated by the state. | |
| 23 | 23 | SECTION 2. This Act takes effect immediately if it receives | |
| 24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
| 25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
| 26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
| 27 | 27 | Act takes effect September 1, 2013. |
