1010 relating to the addition of Salvia divinorum and its derivatives
1111 and extracts to Penalty Group 3 of the Texas Controlled Substances
1212 Act.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 481.104(a), Health and Safety Code, is
1515 amended to read as follows:
1616 (a) Penalty Group 3 consists of:
1717 (1) a material, compound, mixture, or preparation that
1818 contains any quantity of the following substances having a
1919 potential for abuse associated with a stimulant effect on the
2020 central nervous system:
2121 Methylphenidate and its salts; and
2222 Phenmetrazine and its salts;
2323 (2) a material, compound, mixture, or preparation that
2424 contains any quantity of the following substances having a
2525 potential for abuse associated with a depressant effect on the
2626 central nervous system:
2727 a substance that contains any quantity of a
2828 derivative of barbituric acid, or any salt of a derivative of
2929 barbituric acid not otherwise described by this subsection;
3030 a compound, mixture, or preparation containing
3131 amobarbital, secobarbital, pentobarbital, or any salt of any of
3232 these, and one or more active medicinal ingredients that are not
3333 listed in any penalty group;
3434 a suppository dosage form containing amobarbital,
3535 secobarbital, pentobarbital, or any salt of any of these drugs, and
3636 approved by the United States Food and Drug Administration for
3737 marketing only as a suppository;
3838 Alprazolam;
3939 Amobarbital;
4040 Bromazepam;
4141 Camazepam;
4242 Chlordiazepoxide;
4343 Chlorhexadol;

9797 (3) Nalorphine;
9898 (4) a material, compound, mixture, or preparation
9999 containing limited quantities of the following narcotic drugs, or
100100 any of their salts:
101101 not more than 1.8 grams of codeine, or any of its
102102 salts, per 100 milliliters or not more than 90 milligrams per dosage
103103 unit, with an equal or greater quantity of an isoquinoline alkaloid
104104 of opium;
105105 not more than 1.8 grams of codeine, or any of its
106106 salts, per 100 milliliters or not more than 90 milligrams per dosage
107107 unit, with one or more active, nonnarcotic ingredients in
108108 recognized therapeutic amounts;
109109 not more than 300 milligrams of dihydrocodeinone
110110 (hydrocodone), or any of its salts, per 100 milliliters or not more
111111 than 15 milligrams per dosage unit, with a fourfold or greater
112112 quantity of an isoquinoline alkaloid of opium;
113113 not more than 300 milligrams of dihydrocodeinone
114114 (hydrocodone), or any of its salts, per 100 milliliters or not more
115115 than 15 milligrams per dosage unit, with one or more active,
116116 nonnarcotic ingredients in recognized therapeutic amounts;
117117 not more than 1.8 grams of dihydrocodeine, or any
118118 of its salts, per 100 milliliters or not more than 90 milligrams per
119119 dosage unit, with one or more active, nonnarcotic ingredients in
120120 recognized therapeutic amounts;
121121 not more than 300 milligrams of ethylmorphine, or
122122 any of its salts, per 100 milliliters or not more than 15 milligrams
123123 per dosage unit, with one or more active, nonnarcotic ingredients
124124 in recognized therapeutic amounts;
125125 not more than 500 milligrams of opium per 100
126126 milliliters or per 100 grams, or not more than 25 milligrams per
127127 dosage unit, with one or more active, nonnarcotic ingredients in
128128 recognized therapeutic amounts;
129129 not more than 50 milligrams of morphine, or any of
130130 its salts, per 100 milliliters or per 100 grams with one or more
131131 active, nonnarcotic ingredients in recognized therapeutic amounts;
132132 and
133133 not more than 1 milligram of difenoxin and not
134134 less than 25 micrograms of atropine sulfate per dosage unit;
135135 (5) a material, compound, mixture, or preparation that
136136 contains any quantity of the following substances:
137137 Barbital;
138138 Chloral betaine;
139139 Chloral hydrate;
140140 Ethchlorvynol;
141141 Ethinamate;
142142 Meprobamate;
143143 Methohexital;
144144 Methylphenobarbital (Mephobarbital);
145145 Paraldehyde;
146146 Petrichloral; and
147147 Phenobarbital;
148148 (6) Peyote, unless unharvested and growing in its
149149 natural state, meaning all parts of the plant classified
150150 botanically as Lophophora, whether growing or not, the seeds of the
151151 plant, an extract from a part of the plant, and every compound,
152152 manufacture, salt, derivative, mixture, or preparation of the
153153 plant, its seeds, or extracts;
154154 (7) unless listed in another penalty group, a
155155 material, compound, mixture, or preparation that contains any
156156 quantity of the following substances having a stimulant effect on
157157 the central nervous system, including the substance's salts,
158158 optical, position, or geometric isomers, and salts of the
159159 substance's isomers, if the existence of the salts, isomers, and
160160 salts of isomers is possible within the specific chemical
161161 designation:
162162 Benzphetamine;
163163 Cathine [(+)-norpseudoephedrine];
164164 Chlorphentermine;
165165 Clortermine;
166166 Diethylpropion;
167167 Fencamfamin;
168168 Fenfluramine;
169169 Fenproporex;
170170 Mazindol;
171171 Mefenorex;
172172 Modafinil;
173173 Pemoline (including organometallic complexes and
174174 their chelates);
175175 Phendimetrazine;
176176 Phentermine;
177177 Pipradrol;
178178 Sibutramine; and
179179 SPA [(-)-1-dimethylamino-1,2-diphenylethane];
180180 (8) unless specifically excepted or unless listed in
181181 another penalty group, a material, compound, mixture, or
182182 preparation that contains any quantity of the following substance,
183183 including its salts:
184184 Dextropropoxyphene (Alpha-(+)-4-dimethylamino-
185185 1,2-diphenyl-3-methyl-2-propionoxybutane); [and]
186186 (9) an anabolic steroid, including any drug or
187187 hormonal substance, or any substance that is chemically or
188188 pharmacologically related to testosterone, other than an estrogen,
189189 progestin, dehydroepiandrosterone, or corticosteroid, and promotes
190190 muscle growth, including the following drugs and substances and any
191191 salt, ester, or ether of the following drugs and substances:
192192 Androstanediol;
193193 Androstanedione;
194194 Androstenediol;
195195 Androstenedione;
196196 Bolasterone;
197197 Boldenone;
198198 Calusterone;
199199 Clostebol;
200200 Dehydrochlormethyltestosterone;
201201 Delta-1-dihydrotestosterone;

249249 including Salvinorin A.
250250 SECTION 2. This Act takes effect September 1, 2013.
