13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Section 481.104(a), Health and Safety Code, is |
---|
15 | 15 | | amended to read as follows: |
---|
16 | 16 | | (a) Penalty Group 3 consists of: |
---|
17 | 17 | | (1) a material, compound, mixture, or preparation that |
---|
18 | 18 | | contains any quantity of the following substances having a |
---|
19 | 19 | | potential for abuse associated with a stimulant effect on the |
---|
20 | 20 | | central nervous system: |
---|
21 | 21 | | Methylphenidate and its salts; and |
---|
22 | 22 | | Phenmetrazine and its salts; |
---|
23 | 23 | | (2) a material, compound, mixture, or preparation that |
---|
24 | 24 | | contains any quantity of the following substances having a |
---|
25 | 25 | | potential for abuse associated with a depressant effect on the |
---|
26 | 26 | | central nervous system: |
---|
27 | 27 | | a substance that contains any quantity of a |
---|
28 | 28 | | derivative of barbituric acid, or any salt of a derivative of |
---|
29 | 29 | | barbituric acid not otherwise described by this subsection; |
