11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter A, Chapter 87, Election Code, is | |
13 | 13 | amended by adding Section 87.006 to read as follows: | |
14 | 14 | Sec. 87.006. INAPPROPRIATE ACTION BY BOARD. (a) The | |
15 | 15 | presiding judge of the early voting ballot board commits an offense | |
16 | 16 | if the presiding judge knowingly: | |
17 | 17 | (1) accepts the ballot of an ineligible voter; or | |
18 | 18 | (2) refuses to accept the ballot of a person whose | |
19 | 19 | acceptance for voting is required by this code. | |
20 | 20 | (b) The early voting clerk shall report the commission of an | |
21 | 21 | offense under this section to the county or district attorney | |
22 | 22 | having jurisdiction and the secretary of state. | |
23 | 23 | (c) An offense under this section is a Class A misdemeanor. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2013. |
