66 AN ACT
77 relating to the enforcement of water conservation and animal care
88 and control ordinances of a municipality by civil action or
99 quasi-judicial enforcement; providing civil penalties.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 54.012, Local Government Code, is
1212 amended to read as follows:
1313 Sec. 54.012. CIVIL ACTION. A municipality may bring a civil
1414 action for the enforcement of an ordinance:
1515 (1) for the preservation of public safety, relating to
1616 the materials or methods used to construct a building or other
1717 structure or improvement, including the foundation, structural
1818 elements, electrical wiring or apparatus, plumbing and fixtures,
1919 entrances, or exits;
2020 (2) relating to the preservation of public health or
2121 to the fire safety of a building or other structure or improvement,
2222 including provisions relating to materials, types of construction
2323 or design, interior configuration, illumination, warning devices,
2424 sprinklers or other fire suppression devices, availability of water
2525 supply for extinguishing fires, or location, design, or width of
2626 entrances or exits;
2727 (3) for zoning that provides for the use of land or
2828 classifies a parcel of land according to the municipality's
2929 district classification scheme;
3030 (4) establishing criteria for land subdivision or
3131 construction of buildings, including provisions relating to street
3232 width and design, lot size, building width or elevation, setback
3333 requirements, or utility service specifications or requirements;
3434 (5) implementing civil penalties under this
3535 subchapter for conduct classified by statute as a Class C
3636 misdemeanor;
3737 (6) relating to dangerously damaged or deteriorated
3838 structures or improvements;
3939 (7) relating to conditions caused by accumulations of
4040 refuse, vegetation, or other matter that creates breeding and
4141 living places for insects and rodents;
4242 (8) relating to the interior configuration, design,
4343 illumination, or visibility of business premises exhibiting for
4444 viewing by customers while on the premises live or mechanically or
4545 electronically displayed entertainment intended to provide sexual
4646 stimulation or sexual gratification; [or]
4747 (9) relating to point source effluent limitations or
4848 the discharge of a pollutant, other than from a non-point source,
4949 into a sewer system, including a sanitary or storm water sewer
5050 system, owned or controlled by the municipality;
5151 (10) relating to animal care and control; or
5252 (11) relating to water conservation measures,
5353 including watering restrictions.
5454 SECTION 2. Section 54.032, Local Government Code, is
5555 amended to read as follows:
5656 Sec. 54.032. ORDINANCES SUBJECT TO QUASI-JUDICIAL
5757 ENFORCEMENT. This subchapter applies only to ordinances:
5858 (1) for the preservation of public safety, relating to
5959 the materials or methods used to construct a building or
6060 improvement, including the foundation, structural elements,
6161 electrical wiring or apparatus, plumbing and fixtures, entrances,
6262 or exits;
6363 (2) relating to the fire safety of a building or
6464 improvement, including provisions relating to materials, types of
6565 construction or design, warning devices, sprinklers or other fire
6666 suppression devices, availability of water supply for
6767 extinguishing fires, or location, design, or width of entrances or
6868 exits;
6969 (3) relating to dangerously damaged or deteriorated
7070 buildings or improvements;
7171 (4) relating to conditions caused by accumulations of
7272 refuse, vegetation, or other matter that creates breeding and
7373 living places for insects and rodents; [or]
7474 (5) relating to a building code or to the condition,
7575 use, or appearance of property in a municipality;
7676 (6) relating to animal care and control; or
7777 (7) relating to water conservation measures,
7878 including watering restrictions.
7979 SECTION 3. The changes in law made by this Act apply only to
8080 a violation of a municipal ordinance that occurs on or after the
8181 effective date of this Act.
8282 SECTION 4. This Act takes effect September 1, 2013.
