9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 25.0453, Government Code, is amended by | |
11 | 11 | adding Subsection (g) to read as follows: | |
12 | 12 | (g) The judge of a statutory probate court may, unless a | |
13 | 13 | party objects, provide that a proceeding be recorded by a good | |
14 | 14 | quality electronic recording device instead of by a court reporter. | |
15 | 15 | A stenographic record of an electronically recorded proceeding is | |
16 | 16 | not required except on order of the judge. If a recording device is | |
17 | 17 | used, the court reporter is not required to be present to certify | |
18 | 18 | the record. The judge may designate one or more persons to act as | |
19 | 19 | the court recorder and shall assign to a court recorder the duties | |
20 | 20 | and responsibilities necessary to act in that capacity. | |
21 | 21 | SECTION 2. The change in law made by this Act applies only | |
22 | 22 | to a proceeding commenced on or after the effective date of this | |
23 | 23 | Act. A proceeding commenced before the effective date of this Act is | |
24 | 24 | covered by the law in effect immediately before the effective date | |
25 | 25 | of this Act, and the former law is continued in effect for that | |
26 | 26 | purpose. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2013. |
