77 relating to the electronic recording of proceedings in a statutory
88 probate court in Collin County.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 25.0453, Government Code, is amended by
1111 adding Subsection (g) to read as follows:
1212 (g) The judge of a statutory probate court may, unless a
1313 party objects, provide that a proceeding be recorded by a good
1414 quality electronic recording device instead of by a court reporter.
1515 A stenographic record of an electronically recorded proceeding is
1616 not required except on order of the judge. If a recording device is
1717 used, the court reporter is not required to be present to certify
1818 the record. The judge may designate one or more persons to act as
1919 the court recorder and shall assign to a court recorder the duties
2020 and responsibilities necessary to act in that capacity.
2121 SECTION 2. The change in law made by this Act applies only
2222 to a proceeding commenced on or after the effective date of this
2323 Act. A proceeding commenced before the effective date of this Act is
2424 covered by the law in effect immediately before the effective date
2525 of this Act, and the former law is continued in effect for that
2626 purpose.
2727 SECTION 3. This Act takes effect September 1, 2013.
