88 A BILL TO BE ENTITLED
99 AN ACT
1010 relating to the provision of services to certain individuals with
1111 developmental disabilities by a state supported living center.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 161.080, Human Resources Code, is
1414 amended to read as follows:
1515 Sec. 161.080. CONTRACTS FOR SERVICES FOR INDIVIDUALS WITH
1616 DEVELOPMENTAL DISABILITIES. (a) A person that provides
1717 [disability] services to individuals with developmental
1818 disabilities may contract with a state supported living [school or
1919 state] center for the [school or] center to provide services and
2020 resources to support those individuals [with developmental
2121 disabilities, including individuals with dual diagnosis
2222 disorders].
2323 (b) Notwithstanding any other law, a state supported living
2424 [school or state] center may provide nonresidential services to
2525 support an individual if:
2626 (1) the individual:
2727 (A) is receiving services in a program funded by
2828 the department;
2929 (B) meets the eligibility criteria for the
3030 intermediate care facility for persons with intellectual
3131 disabilities [mental retardation] program; and
3232 (C) resides in the area in which the state
3333 supported living [school or state] center is located; and
3434 (2) the provision of services to the individual does
3535 not interfere with the provision of services to a resident of the
3636 state supported living [school or state] center.
3737 SECTION 2. Subchapter D, Chapter 161, Human Resources Code,
3838 is amended by adding Section 161.087 to read as follows:
3939 Sec. 161.087. GIFTS AND GRANTS. (a) The department may
4040 accept gifts and grants of money, personal property, and real
4141 property from public or private sources to expand and improve the
4242 human services programs for the aging and disabled available in
4343 this state.
4444 (b) The department shall use a gift or grant of money,
4545 personal property, or real property made for a specific purpose in
4646 accordance with the purpose expressly prescribed by the donor. The
4747 department may decline the gift or grant if the department
4848 determines that it cannot be economically used for that purpose.
4949 (c) The department shall keep a record of each gift or grant
5050 in the department's central office in the city of Austin.
5151 SECTION 3. Sections 22.001(f) and 101.026, Human Resources
5252 Code, are repealed.
5353 SECTION 4. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2013.
