10 | 10 | | relating to the provision of services to certain individuals with |
---|
11 | 11 | | developmental disabilities by a state supported living center. |
---|
12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 161.080, Human Resources Code, is |
---|
14 | 14 | | amended to read as follows: |
---|
15 | 15 | | Sec. 161.080. CONTRACTS FOR SERVICES FOR INDIVIDUALS WITH |
---|
16 | 16 | | DEVELOPMENTAL DISABILITIES. (a) A person that provides |
---|
17 | 17 | | [disability] services to individuals with developmental |
---|
18 | 18 | | disabilities may contract with a state supported living [school or |
---|
19 | 19 | | state] center for the [school or] center to provide services and |
---|
20 | 20 | | resources to support those individuals [with developmental |
---|
21 | 21 | | disabilities, including individuals with dual diagnosis |
---|
22 | 22 | | disorders]. |
---|
23 | 23 | | (b) Notwithstanding any other law, a state supported living |
---|
24 | 24 | | [school or state] center may provide nonresidential services to |
---|
25 | 25 | | support an individual if: |
---|
26 | 26 | | (1) the individual: |
---|
27 | 27 | | (A) is receiving services in a program funded by |
---|
28 | 28 | | the department; |
---|
29 | 29 | | (B) meets the eligibility criteria for the |
---|
30 | 30 | | intermediate care facility for persons with intellectual |
---|
31 | 31 | | disabilities [mental retardation] program; and |
---|
32 | 32 | | (C) resides in the area in which the state |
---|
33 | 33 | | supported living [school or state] center is located; and |
---|
34 | 34 | | (2) the provision of services to the individual does |
---|
35 | 35 | | not interfere with the provision of services to a resident of the |
---|
36 | 36 | | state supported living [school or state] center. |
---|
37 | 37 | | SECTION 2. Subchapter D, Chapter 161, Human Resources Code, |
---|
38 | 38 | | is amended by adding Section 161.087 to read as follows: |
---|
39 | 39 | | Sec. 161.087. GIFTS AND GRANTS. (a) The department may |
---|
40 | 40 | | accept gifts and grants of money, personal property, and real |
---|
41 | 41 | | property from public or private sources to expand and improve the |
---|
42 | 42 | | human services programs for the aging and disabled available in |
---|
43 | 43 | | this state. |
---|
44 | 44 | | (b) The department shall use a gift or grant of money, |
---|
45 | 45 | | personal property, or real property made for a specific purpose in |
---|
46 | 46 | | accordance with the purpose expressly prescribed by the donor. The |
---|
47 | 47 | | department may decline the gift or grant if the department |
---|
48 | 48 | | determines that it cannot be economically used for that purpose. |
---|
49 | 49 | | (c) The department shall keep a record of each gift or grant |
---|
50 | 50 | | in the department's central office in the city of Austin. |
---|
51 | 51 | | SECTION 3. Sections 22.001(f) and 101.026, Human Resources |
---|
52 | 52 | | Code, are repealed. |
---|
53 | 53 | | SECTION 4. This Act takes effect immediately if it receives |
---|
54 | 54 | | a vote of two-thirds of all the members elected to each house, as |
---|
55 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
56 | 56 | | Act does not receive the vote necessary for immediate effect, this |
---|
57 | 57 | | Act takes effect September 1, 2013. |
