| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Chapter 12, Agriculture Code, is amended by |
|---|
| 16 | 16 | | adding Section 12.0028 to read as follows: |

| 17 | 17 | | Sec. 12.0028. LIMITATION ON SANCTIONS IMPOSED ON SCHOOL |
|---|
| 18 | 18 | | DISTRICTS FOR SALE OF FOODS OF MINIMAL NUTRITIONAL VALUE. (a) In |
|---|
| 19 | 19 | | this section, "food of minimal nutritional value" has the meaning |
|---|
| 20 | 20 | | assigned by 7 C.F.R. Section 210.11(a)(2). |
|---|
| 21 | 21 | | (b) The department may not impose on a school district a |
|---|
| 22 | 22 | | sanction, including disallowing meal reimbursement, based on the |
|---|
| 23 | 23 | | sale to students at a high school of food of minimal nutritional |
|---|
| 24 | 24 | | value, if the sale is approved in advance by the school and is made: |
|---|
| 25 | 25 | | (1) outside of a school area designated for food |
|---|
| 26 | 26 | | service or food consumption or during a period other than a school |
|---|
| 27 | 27 | | meal service period; and |
|---|
| 28 | 28 | | (2) for the purpose of raising money for a student |
|---|
| 29 | 29 | | organization or activity sponsored or sanctioned by the school or |
|---|
| 30 | 30 | | the school district in which the school is located. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2013. |
