11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter A, Chapter 241, Health and Safety |
---|
13 | 13 | | Code, is amended by adding Section 241.009 to read as follows: |

14 | 14 | | Sec. 241.009. PHOTO IDENTIFICATION BADGE REQUIRED. (a) In |
---|
15 | 15 | | this section, "health care provider" means a person who provides |
---|
16 | 16 | | health care services at a hospital: |
---|
17 | 17 | | (1) as a physician; |
---|
18 | 18 | | (2) as an employee of the hospital; |
---|
19 | 19 | | (3) under a contract with the hospital; or |
---|
20 | 20 | | (4) in the course of a training or educational program |
---|
21 | 21 | | at the hospital. |
---|
22 | 22 | | (b) A hospital shall adopt a policy requiring a health care |
---|
23 | 23 | | provider providing direct patient care to wear a photo |
---|
24 | 24 | | identification badge during all patient encounters unless |
---|
25 | 25 | | precluded by adopted isolation or sterilization protocols. The |
---|
26 | 26 | | badge must be of sufficient size, be worn in a manner to be visible, |
---|
27 | 27 | | and clearly state: |
---|
28 | 28 | | (1) at minimum the provider's first or last name; |
---|
29 | 29 | | (2) the department of the hospital with which the |
---|
30 | 30 | | provider is associated; |
---|
31 | 31 | | (3) the provider's title, as assigned by the hospital; |
---|
32 | 32 | | and |
---|
33 | 33 | | (4) if applicable, the provider's status as a student, |
---|
34 | 34 | | intern, trainee, or resident. |
---|
35 | 35 | | SECTION 2. This Act takes effect January 1, 2014. |
