99 relating to the requirement that certain health care providers who
1010 provide services at a hospital wear photo identification.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 241, Health and Safety
1313 Code, is amended by adding Section 241.009 to read as follows:
1414 Sec. 241.009. PHOTO IDENTIFICATION BADGE REQUIRED. (a) In
1515 this section, "health care provider" means a person who provides
1616 health care services at a hospital:
1717 (1) as a physician;
1818 (2) as an employee of the hospital;
1919 (3) under a contract with the hospital; or
2020 (4) in the course of a training or educational program
2121 at the hospital.
2222 (b) A hospital shall adopt a policy requiring a health care
2323 provider providing direct patient care to wear a photo
2424 identification badge during all patient encounters unless
2525 precluded by adopted isolation or sterilization protocols. The
2626 badge must be of sufficient size, be worn in a manner to be visible,
2727 and clearly state:
2828 (1) at minimum the provider's first or last name;
2929 (2) the department of the hospital with which the
3030 provider is associated;
3131 (3) the provider's title, as assigned by the hospital;
3232 and
3333 (4) if applicable, the provider's status as a student,
3434 intern, trainee, or resident.
3535 SECTION 2. This Act takes effect January 1, 2014.
