| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 143.033, Agriculture Code, is amended to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | Sec. 143.033. INJURY TO TRESPASSING ANIMAL. If a person |
|---|
| 16 | 16 | | whose fence is insufficient under this subchapter maims, wounds, or |
|---|
| 17 | 17 | | kills a head of cattle or a horse, mule, jack, [or] jennet, sheep, |
|---|
| 18 | 18 | | or goat, or procures the maiming, wounding, or killing of one of |
|---|
| 19 | 19 | | those animals, by any means, including a gun or a dog, the person is |
|---|
| 20 | 20 | | liable to the owner of the animal for damages. This section does |
|---|
| 21 | 21 | | not authorize a person to maim, wound, or kill any horse, mule, |
|---|
| 22 | 22 | | jack, jennet, sheep, goat, or head of cattle of another person. |
|---|
| 23 | 23 | | SECTION 2. The change in law made by this Act to Section |
|---|
| 24 | 24 | | 143.033, Agriculture Code, applies only to a person who maims, |
|---|
| 25 | 25 | | wounds, kills, or procures the maiming, wounding, or killing of a |
|---|
| 26 | 26 | | sheep or goat on or after the effective date of this Act. A person |
|---|
| 27 | 27 | | who maims, wounds, kills, or procures the maiming, wounding, or |
|---|
| 28 | 28 | | killing of a sheep or goat before the effective date of this Act is |
|---|
| 29 | 29 | | governed by the law in effect on the date the maiming, wounding, |
|---|
| 30 | 30 | | killing, or procurement occurred, and the former law is continued |
|---|
| 31 | 31 | | in effect for that purpose. |

| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2013. |
