1010 AN ACT
1111 relating to liability for injuring a trespassing sheep or goat.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 143.033, Agriculture Code, is amended to
1414 read as follows:
1515 Sec. 143.033. INJURY TO TRESPASSING ANIMAL. If a person
1616 whose fence is insufficient under this subchapter maims, wounds, or
1717 kills a head of cattle or a horse, mule, jack, [or] jennet, sheep,
1818 or goat, or procures the maiming, wounding, or killing of one of
1919 those animals, by any means, including a gun or a dog, the person is
2020 liable to the owner of the animal for damages. This section does
2121 not authorize a person to maim, wound, or kill any horse, mule,
2222 jack, jennet, sheep, goat, or head of cattle of another person.
2323 SECTION 2. The change in law made by this Act to Section
2424 143.033, Agriculture Code, applies only to a person who maims,
2525 wounds, kills, or procures the maiming, wounding, or killing of a
2626 sheep or goat on or after the effective date of this Act. A person
2727 who maims, wounds, kills, or procures the maiming, wounding, or
2828 killing of a sheep or goat before the effective date of this Act is
2929 governed by the law in effect on the date the maiming, wounding,
3030 killing, or procurement occurred, and the former law is continued
3131 in effect for that purpose.
3232 SECTION 3. This Act takes effect September 1, 2013.
