1010 relating to requesting a replacement voter registration
1111 certificate by telephone or electronically.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 15.004, Election Code, is amended to
1414 read as follows:
1515 Sec. 15.004. REPLACEMENT CERTIFICATE. (a) A voter whose
1616 registration certificate is lost or destroyed may obtain a
1717 replacement certificate by:
1818 (1) delivering a written or electronic[, signed]
1919 notice of the loss or destruction to the registrar; or
2020 (2) telephoning the registrar to request a
2121 replacement.
2222 (b) A replacement certificate requested electronically
2323 under Subsection (a)(1) or by telephone under Subsection (a)(2) may
2424 be sent only to the mailing address on the voter's registration
2525 records.
2626 (c) Subject to Subsection (b), not [Not] later than the 30th
2727 day after the date the registrar receives the notice or request, the
2828 registrar shall deliver to the voter a replacement certificate
2929 containing:
3030 (1) the registration number and other information on
3131 the lost or destroyed certificate; and
3232 (2) a notation that the certificate is a replacement.
3333 (d) [(c)] The registrar shall retain a written or electronic
3434 [the] notice submitted under Subsection (a)(1) on file with the
3535 voter's registration application. If the voter requests a
3636 replacement registration certificate by telephone under Subsection
3737 (a)(2), the registrar shall make a written record of the request and
3838 keep the record on file with the voter's registration application.
3939 SECTION 2. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2013.
